CAW 88-129 (I) I am Manager, Regulatory and Legislative Affairs, in the Nuclear and Advanced Technology Division, of the Westinghouse Electric Corporation and as such, I have been specifically delegated the function of reviewing the proprietary information sought to be withheld from public disclosure in connection with nuclear power plant licensing and rulemaking proceedings, and as authorized to apply for its withholding on behalf of the Westinghouse Energy Systems, Nuclear Fuel, and Power Generation Business Units.
(2) I am making this Affidavit in conformance with the provisions of 10CFR Section 2.790 of the Commission's regulations and in conjunction with the Westinghouse application for withholding accompanying this Affidavit.
(3) I have personal knowledge of the criteria and procedures utilized by the Westinghouse Energy Systems, Nuclear Fuel, and Power Generation Business Units in designating information as a trade secret, privileged or as confidential commercial or financial information. ,
(4) Pursuant to the provisions of paragraph (b)(4) of Section 2.790 of the Commission's regulations, the following is furnished for consideration by the Commission in determining whether the information sought to be withheld from public disclosure should be withheld.
(1) The information sought to be withheld from public disclosure is owned and has been held in confidence by Westinghouse.

- 1 CAW-88-129-F (ii) The information is of a type customarily held in confidence by Westinghouse and not customarily disclosed to the public.
Westinghouse has a rational basis for determining the types of information customarily held in' confidence by it and, in that - l connection, utilizes a system to detemine when and whether to I hold certain types of information in confidence. The application of that system s.nd the substance of that system )
constitutes Westinghouse policy and provides the rational' basis required. j Under that system, information is held in confidence if it falls in one or more of several types, the release of which might result in the loss of an existing or potential competitive advantage, as follows:
(a) The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors ,
without license from Westinghouse constitutes a competitive economic advantage over other companies.
(b) It consists of supporting data, including test data, ,
relativetoaprocess(orcomponent, structure, tool, method, etc.), the application of which data secures a competitive economic advantage, e.g., by optimization or improved marketability.

There are sound policy reasons behind the Westinghouse system which include the following: "
(a) The use of such information by Westinghouse gives ,

-l (d) Each component of proprietary information pertinent to a particular competitive advantage is potentially as valuable as the total competitive advantage. If competitors acquire -
components'of proprietary information, any one component j may be.the key to the entire. puzzle, thereby' depriving Westinghouse of a competitive advantage.

Manager, Operations Support Licensing, HL&P, to NRC l Document Control Desk, attention Dr. Thomas Murley, December, 1988. The proprietary information as submitted for use by Houston Lighting and Power Company for the South Texas Project is expected to be applicable in other licensee submittals in response to certain NRC requirements for justification of the integrity of the pressurizer surge line for its design life under thernal stratification conditions.

used in the evaluation of the thermal stratification phenomenon.
(b) Establish revised design transients for the )
pressurizer surge line based on plant monitoring data

(c) Demonstrate the structural integrity of the pressurizer surge line for the 40 year design life, and the acceptability of leak before break and fatigue crack growth, under thermal stratification conditions.
(d) Demonstrate the low likelihood of stratification in the RHR lines, and the integrity of these lines in the ,
event such a condition did exist.
(e) Assist the customer in obtaining NRC approval.
Further this information has substantial commercial value as follows:
(a) Westinghouse plans to sell the use of similar ,
information to its customers for purposes of demonstrating adequate design life for surge lines and RHR lines.
(b) Westinghouse can sell support and defense of the technology to its customers in the licensing process.

Public disclosure of this proprietary information is likely .
to cause substantial harm to the competitive position of-Westinghouse because it would enhance the ability of competitors to provide similar analytical documentation and licensing defense services for connercial power reactors without connensurate expenses. Also, public disclosure of the infomation would emble others to use the infomation i
to meet NRC r:quiremerits for licensing documentation without purchasing the right to use the information._
The development of the technology described in part by the information is the result of applying the results of many years of experience in an intensive Westinghouse effort and the expenditure of a considerable sum of money.
In order for competitors of Westinghouse to duplicate this infomation, similar technical programs would have to be performed and a significant manpower effort, having the ,
requisite talent and experience, would have to be expended for the development, verification, and licensing of adequate methods for evaluation of this phenomenon.
Further the deponent sayeth not.
L ATTACHMENT 1 The temperature differential -between the pressurizer water L Temperature (Tsat). and the wide range hot leg temperature (Loop-
"C" Th) shall be $ 200*F when; draining the pressurizer to the programmed. level setpoint during formation of a pressurizer bubble j or collapsing the pressurizer bubble through the use of the normal-or auxiliary spray valves.
Action Statement If the temperature differential between the pressurizer water-temperature (Tsat) and the ' wide range hot. leg temperature (Loop.
"C" Th) exceeds 200*F, than operations which are causing the-increasing temperature differential shall be suspended and actions shall be immediately initiated to meet the 200*F. differential criteria.
Surveillance Requirements The following parameters shall be recorded every.15 minutes, during heatup and cooldown of the reactor coolant system or pressurizer:
- 1. Wide range hot leg temperatures (A, B, C)
- 2. Pressurizer water temperature
- 3. Pressurizer pressure
- 4. Temperature differential between the pressurizer (Tsat) and the 1C loop hot leg temperature to verify that the 200*F criteria are met.
Basis Data recorded during Hot Functional Testing and Power Accension Testing indicate that the pressurizer surge line is subjected to excessive displacements during plant heatup. Maximum displacements were recorded during draining of the pressurizer while forming a steam bubble. During all other. phases.
displacements were of a lower magnitude. This is presumably caused by constant outflow from the pressurizer during draining for an extended period of time. During other phases of heatup, outsurge and insurge periods are short. It is reasoned that collapse of the steam bubble during cooldown would also produce similar effects on the piping. By limiting the temperature differential between the pressurizer and hot leg to 5 200'F, specifically during steam bubble formation and collapse, the excessive piping displacements would be minimized thereby reducing thermal stresses in the surge line piping.
