VIOLATION CONSIDERED'FOR ESCALATED ENFORCEMENT This refers.to the Nuclear Regulatory Commission (NRC) inspection conducted by P. K. Van Doorn on February, 28 - March 29,1989, at the McGuire Nuclear Plant.'

LThe inspection included a review of the circumstances surrounding a design Air Ldeficiency i(VG) systeminvolving an interface between and the non-safety-related the Diesel Instrument and non-seismic Generator Air Starting (VI) system..

The report documenting this inspection was sent to'you by letter dated April 21,

'1989. As a result of.this inspection,- an apparent failure to comply with NRC

,, regulatory requirements was identified, and accordingly, NRC concerns relative

-to the inspection findings were discussed in an Enforcement Conference held on April 28,1989. The letter summarizing this conference .was sent. to you on May 15, 1989.

.The VG/VI' interface was provided to supply control air for certain valves which' would aid operators in a plant shutdown in the event of a Control. Room evacua-tion coincident with a Loss of Offsite Power. The valves 'are supplied via' a Blackout Header. You identified the design deficiency in a Self-Initiated Technical Audit (SITA) in 'May 1988. You took-immediate corrective action by closing manual isolation valves in the VG system to prevent inadvertent depres-surization of the VG system. Testing to determine past operability of the VG system and associated DGs was conducted over the period from June 1988 to

' February 1989. Testing was- difficult due to testing on-line. Additionally, it

. was difficult to determine acceptance criteria relative to the amount of air flow required for VI. Testing of Unit 2, completed in July 1989, indicated that the DGs may have been operable; however, results were inconclusive.

- Testing of Unit 1, Train A, was conducted in November 1988. Subsequent to the test a VI check valve failed to reseat. If this had occurred during an actual i event, VG could have been depleted of air, shutting down the diesel generator.

The check valve was installed to prevent VG from feeding portions of VI other than the Blackout Header. We were informed when you identified the possible problem and were subsequently informed of test results as they developed.

j f Lw (DukefowedCompany- 2 # I 4 1989 Duke has recently determined that the Blackout Headers are " seismically rugged" using criteria of the Seismic Qualification Utility Group. In addition,-no unacceptable. seismic interactions were identified.

Your specific long-term corrective actions include updating the FSAR to clarify the basis for the Blackout Header and pursuit of an alternate source of air for the Blackout Header. The improved program for design reviews (Top Form) has been fully implemented and you will continue the SITA reviews. In addition,

.you have; begun a' design basis reconstitution program. An NRC/RII meeting to discuss;the latter program was held on May 25, 1989.. We understand that you will provide a schedule for completion of long term actions to NRC/RII.

The violation of design control has been categorized as a Severity _ Level IV because, under limited conditions described above, one train. of the emergency diesel power system would have been inoperable. As specified in Section V.G.1-of the NRC Enforcement Policy, the NRC wants to encourage and support licensee initiative for self-identification and correction of problems; therefore, a notice of violation is not being issued.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title'10. Code of Federal Regulations, a copy of this letter and its enclosure will be placed in the NRC Public Document Room.
