1 This is in further response to your letter dated July 21, 1986, in which you appealed Mr. Donnie H. Grimsley's letter dated June 24, 1986.
Mr. Grimsley's letter denied documents in whole or in part that were subject to your Freedom of Information Act (F0IA) request for documents related to the NRC Comanche Peak Task Force. My letter to you dated April 10, 1987, addressed the agreement which was the basis for deleting certain information in the requested documents. This letter addresses those portions of 35 documents listed on Appendix R which were initially denied pursuant to an F0IA exemption.
For your information, an additional document, R-234, was placed in its entirety in the NRC Public Document Room in response to your request as part of the documents disclosed in Mr. Grimsley's letter dated June 24, 1986.
Acting on your appeal I have carefully reviewed the record in this case and have determined that the previously withheld information in the 34 documents will continue to be withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(aj f 5) of the Commission's regulations.
Your appeal is, therefore, denied.
i As stated in Mr. Grimsley's letter dated June 24, 1986, the withhsid portions of these documents relate to the subject of potential violations. The withheld information was predecisional to the 13 suing of 1
the enforcement action on Comanche Peak.
Exemption (5) shields from mandatory disclosure information generated in the deliberative process that precedes most decisions of government agencies.
This is a final agency action. As set forth in the F0IA (5 U.S.C.
552(a)(4)(B)), judicial review of this decision is available in a district court of the United States in the district in which you reside or have your principal place of business or in the District of Columbia.

Dear Mr. Stello:
This is an appeal pursuant to subsection a(6) of the Freedom of Information Act as amended (5 U.S.C.
522),
of the actual denial of the Commission to release documents requested on January 21, 1985 by the Government Accountability Project (GAP) regarding the Comanche Peak Task Force established in March 1984.
By letter dated June 24, 1986, Mr. Donnie Grimsley, Director of the Division of Rules and Records advised us that of the 286 allegation tracking system documents described on Appendix R, portions of 35 documents were being withheld pursuant to FOIA Exemption 5 because they contain the advice, opinions and recommendations of the staf f concerning potential violations.
In addition, Mr. Grimsley advised us that portions of 100 documents and 57 documents in their entirety were being withheld pursuant to an agreement reached between the NRC staff and myself at a meeting on May 8,
1985, that information concerning allegers, interviewees and other individuals would be protected f rom disclosure.
Please be advised that our agreement applied only to allegers.
To the extent the withheld documents relate to anyone but allegers, we appeal their denied release.
We believe we are entitled to release of the documents and portions of documents being withheld.
We expect your response to this appeal within 20 working days of your receipt so that we can determine whether to pursue this matter further in the courts.

Portions of the records identified at numbers 224, 226 thrbugh258,and274 contain information that is being withheld from public disclosure pursuant to Exemption (5) of the FOIA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(c)(5) of the Commission's regulations. The withheld portions contain the advice, opinions, and recommendations of the staff concerning potential violations.
The nonexempt portions of these records are being placed in PDR file F01A-85-59 under your name.

Pursuant to CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from prcduction nr. disclosure and that its production or disclosure is contrary to the public interest.
