Dear Mr. Kohn:

This is in response to your letter dated February 5,1985, in which you requested, pursuant to the Freedom of Information Act (FOIA), all records regarding Donald Nisich concerning the South Texas and Comanche Peak nuclear power plants.

Listed on the enclosed appendix are documents which have been determined to be ,

subject to your request. Portions of documents 3, 11, 12, and 14 have been withheld from public disclosure pursuant to Exemption (6) of the F0IA (5 U.S.C.

552(b)(6)) and 10 CFR 9.5(a)(6) of the Commission's regulations. The withheld portions consist of home addresses and other personal information the disclosure of which would constitute a clearly unwarranted invasion of personal privacy.

These documents are being placed in the NRC Public Document Room (PDR), 1717 H Street, NW, Washington, DC 20555, in folder FOIA-85-91 under your name.

Additional documents subject to your request were processed under a previous related request, F01A-85-59, from your organization, and are available in PDR file F01A-85-59 under the name of Garde.

Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclesure is contrary to the public interest. The person responsible for the denial is Mr. Ben B. Hayes, Director, Office of Investigations.
