SUBJECT: NOTICE OF. VIOLATION

'NRC; INSPECTION REPORT NOS. 50-369/87-26 AND.50-370/87-26

This ' refers to the! Nuclear Regulatory Commission (NRC) inspection conducted by

.

L. L'. : Lawyer' on ; August 3-7,,1967.

The inspection included a review of'

activities authorized for your McGuire , facility.

At the conclusion of. the

inspection, the findings were l discussed with those ' members of your staff

identified in the enclosed report.

. Areas examined during the inspection are identified in the report.

Within

these areas, the. inspection consisted of selective examinations.of procedures

and '_ representative records, interviews with personnel, and . observation of

activities in progress'.

' The ' inspection findings indicated that activities pertaining to the use of

overtime violated NRC requirements.

This violation, references to pertinent

requirements, and elements to be included in your response are described in the

enclosed Notice of Violation.

Additionally, the NRC is concerned with the activities pertaining (to theD/G1A).

inoperability of-the Unit 1, Train A, Emergency Diesel Generator

Of.particular concern is the fact that six control room shift turnovers

occurred without proper corrective action being taken in response .to control

room indications that D/G 1A was in an inoperable status.

Inspection findings

pertaining .to the inoperability of D/G 1A and control room operations violate

NRC ' requi rements .

These violations, described in the enclosed report, are

under consideration for escalated enforcement action.

Accordingly, a Notice

of. Violation is not being issued for these items, and no response for these items

is required. However, please be advised that the number and characteristics of

these violations described in the enclosed report may change as a result of

further NRC review.

These areas will be addressed during the Enforcement

Conference scheduled for September 15, 1987, in the Region II office.

In accordance with 10 CFR 2.790(a), a copy of this letter, its enclosures, and

any reply will be placed in the NRC Public Document Room.
