l ENCLOSURE 1 NOTICE OF VIOLATION DbkePowerCompany' Docket Nos. 50-369 and 50-370

.McGuire. Units 1 and'2 License Nos. NPF-9 and NPF-7 During' the ' Nuclear Regulatory Commission (NRC) inspection conducted 'on August 3-7, 1987,- a violation of NRC requirements was identified. The violation : involved a . failure to comply c ith Technical Specifications and procedures 1 governing the use of overtime.for persons performing safety-related

. functions. In accordance with the " General Statement of Policy and Procedure

! for NRC Enforcement Actions " 10 CFR Part 2, Appendix C (1987), the violation is listed below:

Technical Specification 6.2.2.f requires that adequate shift coverage shall be maintained without routine heavy use'of overtime and states

' that under certain' circumstances when substantial amounts of overtime are required, an individual should not be permitted to work more than 16 hours1.851852e-4 days <br />0.00444 hours <br />2.645503e-5 weeks <br />6.088e-6 months <br /> in any 24-hour period nor more than-72 hours in any 7-day period, excluding shift turnover time. Technical Specification 6.2.2.f requires that any deviation from the above guideline shall be authorized by the Station Manager or his deputy, or higher levels of management,

in accordance with established procedures and with documentation of the basis for granting the deviation. Station' Directive 2.0.10, Overtime Authorization for Personnel Performing Safety Related~ Functions, Revision 2, which implements ' Technical Specification 6.2.2.f, requires that excessive

' overtime be authorized in advance and documented on a Request for Work Hour Extension form.

Contrary to the above, on five occasions during the month of June 1987, individuals worked overtime in excess of the Technical Specification limit of 72. hours in a 7-day period without the required management approval, and on numerous occasions during the months of September and October 1986, March 1987, and May through July 1987, Request for Work Hour Extension forms were approved after the. excessive overtime had been worked.

Station Directive 2.0.10 allows the Shift Engineer on duty to approve work hour extensions, although Technical Specification 6.2.P.f requires this function to be performed by the Station Manager, his deputy, or higher levels of management.

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit to this Office within 30 days of tre date of the letter transmitting this Notice a written statement or explanation in reply including:

achieved. (4) the corrective steps which will be taken to . avoid further {

violations, and (5) the date when full compliance will be achieved. Where good j cause is shown, consideration will be given to extending the response time.
