Purpose To set forth the regional procedure for the > eparation and processing of a Confirmatory Action Letter (CAL).
References 10 CFR 2, Appendix C - Section V.E(3)
IE Manual Chapter 0400 - Section 0400 - 05.07.d B.
Discussion The HRC Enforcement Policy (10 CFR 2, Appendix C) identifies a CAL as a letter confirming a licensee's agreement to take certain actions to remove significant concerns about health and safety, safeguards, or the l
environment.
In accordance with IE Manual Chapter 0400, a CAL may be used if the NRC has concerns that require an immediate corrective action of a l
short-term nature.
If extensive long-term corrective actions are necessery, (for example, requiring greater than 30 days), a Confirmatory Order should be used.
The CAL shall consist of concise statements which clearly specify the commitments made by the licensee to alleviate the NRC j
concerns. This instruction serves to:
Identify the responsibilities of regional personnel involved with the preparation, review and issuar,ce of a CAL: and 1
Provide the Region I format and style for a CAL.

Procedure Implementation 1.
The Division determining the need for a CAL shall, on the day of that determination:
a.
Obtain a CAL No. from the Secretary to the Enforcement Officer; b.
Prepare the CAL for the Division Director's signature in the style and format illustrated in the enclosed example, using clear and concise action statements (For a very significant CAL, j
the Regional Administrator may decide to sign the CAL);
c.
Obtain the concurrence of the Enforcement Officer, Regional Counsel, Deputy Regional Administrator and Regional l
Administrator.
If a CAL for a power reactvr is prepared by.a Division other than DRP, (for example, for concerns related to security, health physics, fire protection, equipment qualification etc.), that Division shall also obtain the concurrence of DRP.
If a CAL for a power reactor is prepared by DRP for such technical concerns normally handled by another Division, DRP shall obtain the concurrence of that Division.

Contact the licensee by telephone, after the Regional Administrator or his designee concurs in the draft CAL, to I

assure that the licensee agrees to the commitments stated in the

CAL.
If the licensee agrees to those commitments, the Division l
Director (or the Regional Administrator for a very significant CAL) shall sign and issue the CAL.
If the licensee does not agree to those commitments, the Division shall either modify the
)
CAL to incorporate the licensee's concerns, after obtaining the l
Regional Administ ator's concurrence, or, if such modification is inappropriate, shall contact the Enforcement Officer for preparation of an Order.
Transmit tne signed and dated CAL to the licensee by mail and e.
facsimile (if the licensee possesses facsimile capability), and i
distribute the CAL to (1) the normal cc and bec distribution i
list for that lfcensee, (2) all individuals on the concurrence list, (3) the Secretary to the Enforcement Officer, and (4) the Director of Enforcement, IE.
2.
The Secretary to the Enforcement Officer shall issue, as requested, sequential CAL numbers by calendar year, and shall maintain a complete sequential file of all CALs issued by the Region.

Pursuant to our telephone conversation on (date), it is our understanding that you have taken or will take the following actions:
1.
Maintain all affected equipment related to the events which occurred on (date), in its as-found condition (except as necessary to maintain the plant in a safe shutdown condition) in order to preserve any evidence which would be needed to inspect or reconstruct the events.
2.
Develop troubleshooting plans and procedures and provide those to the NRC Augmented Inspection Team (AIT) for their review and comment prior to initiating any troubleshooting of the affected equipment.
3.
Advise the AIT leader prior to the conduct of any troubleshooting activities.
4.
Make available to the NRC AIT relevant written material related to previous problems with the affected equipment.
5.
Provide a written report to the Regional Administrator prior to restart that contains your evaluation of the following:
a.
Intersystem leakage through the motor-operated injection valves (including the check valve) of the residual heat removal system; b.
The primary containment isolation which occurred during shutdown after the reactor mode switch was repositioned from the run mode to the startup mode; The failure of the outboard main steam isolation valves to reopen c.
after resetting the primary containment isolation signal.
This report should include the underlying causes for the above noted events, an assessment of their relationship to previous events including the events of (date), corrective actions taken and your basis for restart, including the criteria used and your analyses associated with these criteria.

Further, we understand that restart will not occur until you receive authorization from the Regional Administrator.
