JUSTIFICATION FOR EXPEDITED PROCESSING NRC's FY 1998.

PROPOSED FEE RULE This is to confirm our recent telephone conversation on the urgency of publication in the Federal Register of the NRC's proposed FY 1998 fee rule ' y March 31,1998.

o The NRC is required by the Omnibus Budget Reconciliation Act (OBRA-90) to collect approximately 100 percent of its budgeted costs through license and annual fees, and is required to do so through notice and comment rulemaking each year. In order to a#ect this mandate to bill and collect by September 30,1998, it is imperative that our proposed fee rule be

- published by the end of March. We must allow a 30-day comment period and, dependent on

the number and complexity of the comments received, we need to analyze those comments

)

and fold into the final rule the results of that analysis. Once we issue the final pJie, another law mandates that it is not effective until 60 days after publication. Only when the rule is finally effective can we issue the bills to affect collection of our budget. Those bills allow a 30-day interest-free period in which to make payment in accordance with the Debt Collection Improvement Act of 1996.

As you can see, in order to assure we meet our Congressional mandate to bill and collect 100 percent of our budget by September 30,1998, the timing of the publication of the proposed rule is critical to meeting our goal.

I apologize for providing you the rule so late in the month and not identifying the urgency of getting it published. Any assistance you can lend toward getting our proposed fee rule published in the month of March will be greatly appreciated.
