By Northem States Power Company's (NSP's) submittal dated June 8,1998, and Combustion J
- Engineering, Inc.'s (CE's) affidavit dated May 15,1998, executed by 1. C. Rickard, NSP submitted its generic licensing report on steam generator tube repair using refolling and l
requested that Attachment 2 (CE Report CEN-620-P, Revision 05-P, " Series 44 & 51 Design i
Steam Generator Tube Repair Using a Tube Rerolling Technique," May 1998, be withheld from 1
l public disclosure pursuant to 10 CFR 2.790. NSP also submitted a nonproprietary version of l
this report as Attachment 3 to its June 8,1998, letter, for placement in the NRC Public Document Room.

CE stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:
Public disclosure of the information is likely to cause substantial harm to the competitive L
position of CE because:

- 1. a similar product is manufactured and sold by major pressurized water reactor competitors of CE.

- 2. development of this information by CE required tens of thousands of dollars and hundreds of manhours of effort. A competitor would have to undergo similar l
expense in generating equivalent information; Q

- 3. In order to acquire such information, a competitor would also require considerable j
time and inconvenience to develop and validate a similar tube rerolling repair technique.

- 6. use'of the information by competitors in the intemational marketplace would increase their ability to market nuclear steam supply systems by reducing the costs associated with their technology development. In addition, disclosure would have an l.
adverse economic impact on CE's potential for obtaining or maintaining foreign L
licensees.
l We have reviewed NSP's submittal and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of these etatements, have determined that the submitted information sought to be withheld contains proprietary commercial information.
Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act -
of 1954, as amended.
Withholding from public inspection shall not' affect the right, if any, of persons properly and i
directly concerned to inspect the documents.- If the need arises, we may send copies of this
. information to our consultants working in this area. We will, of course, ensure that the L
consultants have signed the appropriate agreements for handt:ng proprietary information.
' If the basis for withholding this information from public inspection'should change in the future i
such that the information could then be made available for public inspection, you should L
promptly notify the NRC. You also should understand that the NRC may have cause to review l
this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination -
adverse to the above, you will be notified in advance of any public disclosure.
