Dear Mr. Stello:
1 This is an appeal pursuant to subsection a(6) of the Freedom of Information Act as amended (5 U.S.C.
522), of the actual denial of the Commission to release documents requested on January 21, 1985 by the Government Accountability Project (GAP) regarding the Comanche Peak Task Force established in March 1984.
By letter dated June 4,
- 1986, Mr. Donnie Grimsley, Director of the Division of Rules and Records advised us that of 94 docu-ments relating to draft supplemental safety evaluation reports designated as Appendix 0, portions of 81 documents were being withheld pursuant to FOI A Exemption 5 because they contain the advice, opinions and recommendations of the staff concerning potential violations.
We believe we are entitled to release of the portions of documents being withheld.
i We expect your response to this appeal within 20 working days of your receipt so that we can determine whether to pursue this matter further in the courts.

This is in further response to your letter dated January 21, 1985, inJwhich you requested, pursuant to the Freedom of Information Act (FOIA), records related to the NRC Comanche Peak Task Force established in March 1984.
We are now placing a box of draft supplemental safety evaluation reports (Appendix 0 records numbered 1 though 94) into the Public Document Room (PDR) for public inspection and copying.
The records will be maintained in PDR file j

88 through 94 are being withheld from public disclosure pursuant to Exemption

(5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations. The withheld portions contain the advice, opinions, and l
recommendation of the staff concerning potential violations.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest.
The persons responsible for this denial are the undersigned and Mr. Harold R. Denton, Director, Office of Nuclear Reactor Regulation.
This denial may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter.
Any such appeal must be in writing, addressed to the Executive Director for Operations U.S. Nuclear Regulato:y Commission, Washington, DC 20555, and should clearly state on the' envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

Through its Citizens Clinic, GAP offers assistance to local public interest and citizens groups seeking to ensure the health and safety of their communities.
The Citizens Clinic is currently assisting several citizens groups, local governments and interveners in the central Texas area concerning the construction of the Comanche Peak nuclear power plant.
