w ENCLOSURE 1 NOTICE OF VIOLATION Docket Nos. 50-413 and 50-414 Duke Power Company License Nos. NPF-35 and NPF-52 Catawba During the Nuclear Regulatory Commission (NRC)' inspection conducted on 22-26,.1986, a violation of NRC requirements was identified.
The September violation involved failure to conduct a semi-annual Health Physics drill which includes the Post Accident Containment Air Sampling System.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions,"
10 CFR Part 2 Appendix C (1986), the violation is listed below:
10 CFR 50.54(q) states that a nuclear power reactor licensee shall follow and maintain in effect an emergency plan which meets the Standards in 10 CFR 50.47(b) and the requirements of Appendix E to 10 CFR Part 50.
Section N.2.e of the licensee's emergency plan states that Health Physics drills shall be conducted semi-annually which in.volve the Post Accident Liquid Sampling System and the Post Accident Containment Air Sampling System operation to. collect simulated elevated airborne and liquid samples and direct radiation measurements in the environinent.
Contrary to the above, during the calendar year 1985, no Health Physics drill involving the collection of simulated elevated airborne samples from the Post Accident Containment Ai-Sampling Sys_ tem was conducted.
This is a Severity Level IV violation (Supplement VIII).
Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including:
(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the
. corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.
Where good cause is shown, consideration will be given to extending the response time.
