Dear Congressman Richmond:

Thank you for your letter dated August 3,1982, concerning the Commission's ongoing Indian Point proceeding.

The Commission appreciates your interest and your concerns regarding the Indian Point plant.

Even so, I am sure that you can understand that it must decide this adjudication solely on the basis of the submissions of the parties and its evaluations of those submissions.

To do otherwise would be unfair to the parties and could also jeopardize the validity of the Commission decision.

The Comission has asked the Licensing Board to reconsider expeditiously its rulings on the admissibility of contentions already accepted to the proceed-ing, refomulating them in accordance with the Commission's latest guidance.

Further action by the Commission, if any, should await the results of the Board's reconsideration.

On August 9,1982, the Board certified four questions to the Commission seek-ing further guidance.

A copy of the Board's order is enclosed.

I expect that the Commission will respond to the questions in the near future.

Comissioner Gilinsky's views on this subject are expressed in the enclosed copy of a letter sich he recently wrote to Congressman Ottinger.

Our office will be happy to keep you infomed of developments in this matter.
