NRC STAFF'S FIFTH PROGRESS REPORT AND ANNOTATED BIBLIOGRAPHY 1.
PROGRESS REPORT This prog ress report is prepared in response to the Licensing Board's " Memorandum and Order (Progress Report and Notice of Available Documents)" dated June 6,1986.
1.
ORGANIZATION AND STAFF On March 19, 1987, the EDO further identified the organization and staff assignments for the newly formed TVA and Comanche Peak Project Divisions in the Office of Special Projects (OSP), issued details on the specific functions for the Office, and delegated to it certain authorities (Enclosures 1 and 2).
The present organization chart, excluding existing i
vacancies, for the Comanche Peak Project Division (CPPD) is attached (Enclosure 3).
The CPPD headquarters staff has been consolidated into one location in Bethesda, Maryland.

.' sufficiently large to accommodate the entire CPPD staff.
Logistical support and equipment are being procured to enable the onsite NRC Inspectors to work more effectively and to enable the Staff to issue reports and correspondence from the site.
CPPD policy is that all CPPD staff perform their review and evaluation of specific technical issues at the site as much as possible.
Effective May 24, 1987, R. F. Warnick was assigned to the Comanche Peak site as Assistant Director for inspection Programs for CPPD.
The onsite NRC inspectors have been organized into three groups, Operations, Construction, and Comanche Peak Response Team (CPRT), with the lead individuals being D.
Kelley (Senior Resident, Operations),
S.
Phillips (Senior Resident, Construction), and I. Barnes (CPRT).
W. Smith has been selected as Resident inspector, Operations, and will be on site in June 1987.
Efforts are in progress to add additional experienced personnel to the inspection staff.
In the future, each group of the onsite inspection staff will issue a monthly inspection report.
In accordance with the EDO objectives (Enclosure 2) the CPPD will perform all necessary routine licensing functions, evaluation of the Applicants' CPRT efforts,
including c corrective
- actions, and most inspection activities.
The CPPD will utilize Staff resources in other offices if such effort had been initiated prior to the formation of OSP, if the effort is generic, or if special expertise is required.
in particular, CPPD will be supported by Region IV regarding radiological controls, security and safeguards, emergency preparedness, and operator licensing (Enclosure 4).

CONSTRUCTION PERMITS The status of the Staff's and App!! cants' appeal in the Unit 1 Construction Permit extension proceeding has not changed.
By letter dated April 29, 1987, Applicants applied, pursuant to 10 C.F.R. 50.55(b), for an extension of Construction Permit CPPR-127 for the Comanche Peak Steam Electric Station, Unit 2.
The current permit has a construction completion date of August 1,
1987; the requested new completion date is August 1,
1990.
The application is under Staff consideration.
4.
STAFF REVIEW AND EFFORTS The. Applicants provided to the Staff an overview on the CPRT efforts and the associated corrective action program (CAP), in two public meetings on April 2 and 7,
1987, in Bethesda, Maryland and Dallas, Texas, respectively.
Because of changes to the CPRT Program Plan since Revision 3 was issued (January 27, 1986), in a letter dated May 12, 1987, j

The Staff notes its disagreement with CASE's characterization on page 3 of CASE's Fifth Progress Report regarding the scope of Chairman Bloch's March 2,1987 telephone call.

_4-the Staff requested the Applicants to issue Revision 4 to the plan, including the details as discussed in the two meetings.
The Staff also' requested information on and clarifications of the present scope, purpose, and objectives of major ongoing programs and evaluations necessary for the licensing of Comanche Peak, and the differences and interrelationships among programs.
The Staff intends to use the information provided by the Appilcants to develop a comprehensive review and inspection program for Comanche Peak licensing activities.
Since the last progress report the Applicants have submitted eight i
results reports.
To date, NRC has received 35 results reports for review.
The CPPD headquarters staff visited the site during the week of May 18, 1987, to inspect and audit selected efforts by the Applicants.
5.
ONSITE INSPECTION ACTIVITIES The NRC onsite inspectors and consultants continued their inspections in operations and CPRT areas.
During January and February 1987,- NRC inspectors and consultants conducted a team inspection of the Applicants' CPRT evaluations of the safety significance of the Applicants' inspection and documentation findings.
Results of the team inspection are being documented in inspection Report 50-445/8704; 50-446/8704.
NRC inspectors identified the following three major concerns:
a.
By letter dated September 5,1986, Brown Boveri, supplier of the Class 1E 6.9 kv circuit breakers, notified the Appilcants that a seismic event could cause malfunction of the breakers because of the excessive slope of the concrete floor.

s Applicants issued a nonconformance report for ' the excessive slope..
NRC observed the repair work on February 13, 1987, the ~ same day the Applicants made notification per 10 C.F.R. 50.55(e).
Results are documented in Inspection Reports 50-445/8703, 50-446/8703; and 50-445/8607, 50-446/8706.
The failure to report this deficiency to the NRC earlier is being pursued.
b.
The NRC inspectors have questioned the timeliness of the Applicants' determination. of reportability under 10 C.F.R. 50.55(e) for all nonconforming conditions.
The NRC Resident inspectors have expressed this concern to.the Applicants.

The Staff has questioned the Applicants' procedures for controlling system cleanliness from construction until turnover to operations.
The NRC onsite inspectors have requested a
meeting with representatives of construction, start-up, and operations to resolve this concern.

The purpose of this memorandum is to describe the assignment and location of OSP staff members..
OSP became operational March 1, 1987. The staff members to be assigned to OSP.
effective March 29, 1987 are listed in Enclosure 1.
Additional people will be detailed or reassigned on an as needed basis. Actions affecting bargaining unit employees will be taken in accordance with the collective bargaining -
agreement. Individuals detailed or assigned to OSP will return to their regular or comparable positions upon completion of their assignments.

OSP management can now be reached on FTS-492-7761.
. All OSP Headquarters staff will likely be consolidated into the East West /
West or Air Rights buildings. Telephone nutrhers of assigned personnel will be issued after office assignments have been made.
The Assistant Directorates for Regional Operations will be in RII for the TVA projects and the Comanche Peak site for that project. Office space, travel.
and T/A support for the OSP regional staffs will be provided by the regional offices except that special arrangements will be made for Comanche Peak personnel located at the site. All other support will be handled through Headquarters.

DELEGATION OF AUTHORITY TO THE OFFICE OF SPECIAL PROJECTS Effective' February'9,1987, the Office of Special Projects was established.
'That office is to efficiently and aggressively:
- 1) assure the identification and resolution of those problems which gave rise to the shutdown of TVA's Sequoyah and Browns Ferry' facilities.and of steps necessary to prevent their recurrence; and 2) evaluate TVA's Wetts Bar and Bellefonte and Texas Utilities' Comanche Peak facilities in order to detemine compliance with the Comission's regulatory requirements; to assess whether identified problems are on a path to an acceptable solution, and where not, to identify acceptable solutions
,g necessary to enable the staff to complete its licensing reviews of these facilities, consistent with the NRC's statutory mandate to protect the health and safety of the public.
To carry out these functions, the Office of Special Projects is hereby delegated the authority to:
Take all actions, except an enumerated helow, associated with the licensing of the TVA facilitias and the Comanche Peak facility, including determinations of complierce with or issuance of exemptions from the regulations.
The Directer, Office of Special Projects, is not delegated the authority to issue or revoke construction permits or operating licenses. That authority is retained by the EDO.
Perform all safety and environmental reviews and evaluations and issue i
associated safety evaluations, environmental assessments, environmental impact statements, and other related documentation necessary to support its advice and reconnendations to the EDO regarding licensing decisions pertaining to the TVA and Comanche Peak facilities.
Cenduct inspection activities related to the licensing of the TVA and Conanche Peak facilities.
Conduct enforcenent activities including conduct of enforcement conferences, issuance of notices of viola *.icn purscent to 10 CFr 2.201, and issuance of proposed civil penalties pursuant to 10 CFR 2.205 subject to the approval n' the Director, Office of Inspectien and Enforcenent, until April 12, 1907, and thereafter, the Deputy Executive Director for Regional Operations.

Issue orders for the modification nr suspension of licenses pursuert tn 10 CFR 2.202 and 2.204.
Erfnrcement orders are to be coordinated with the Deputy Executive Director for Regional Operations. Licensing i

Serve as the principal point of contact for the NRC with the Advisory

Comittee on Reactor Safeguards for matters under review by OSP.
I Develop procedures to assure the timely scheduling, review, and processing j
of all matters under review by the Office.
Administer oaths and affirmations, and issue subpoenas where necessary and appropriate pursuant to section 161c of the Atomic Energy Act of

1954. as amended, to enable the Director to conduct examination o' matters within the functions and authorities of the Office of Special f

Identify research needs required for the above programs.
Issue appropriate Federal Repister notices in connection with the actions delegated herein, including notices which offer an opportunity for public hearing in connection with the action proposed to be taken, whether or not required by statute or the Comission's regulations.
Supervise, direct, coordinate, and approve the activities, including ahinistrative functions, of the various organizational units within the Office.
Perform such other functions as may be assigned.

The ED0's March 19, 1987 memorandum to me delegated to_the Office of Special Projects'the authcrity and responsibility for the conduct of inspection ac-tivities related to the licensing of the Comanche Peak facilities. The ED0's u
Narch 19, 1987 memorandum to you identified staff members to be assigned to the Office of Special Projects (OSP). The Region IV. staff members identified as being assigned to OSP were those individuals presently working at the site, plus. Joe Tapia, who is currently working in the Region IV office. During the past several weeks, we have taken a more detailed look at the staffing needed to support inspections and operator licensing at Comanche Peak. Phil McKee talked to several of your staff about this subject during his visit to the Regional Office and.the Comanche' Peak site in early April.
Based on our further evaluation, we project a need for support from Region IV in the following areas:

J For the first three areas listed above, we request that Region IV provide the l
inspection resources necessary to complete the routine preoperational phase inspections reqtiired by Inspection and Enforcement Manual Chapter 2513.
For the fourth area, we request that Region IV. continue to administer operator and senior operator licensing examinations to appropriate TU Electric Company personnel. As.an efficient approach to coordinating Region IV's support, I pro-pose that the' Assistant Director for CP Inspection Programs, OSP, work directly with the Regional Section Chiefs who are responsible for these areas. We under-stand that the Section Chiefs currently assigned to these areas are Blaine Murray (Radiological Controls), Lawrence Yandell (Emergency Preparedness and Security) and Ralph Cooley (Operator Licensing). Correspondence with TV Electric Company related to these activities would be issued through OSP. Any conflicts in this arrangement, such as with schedules or resources, could be worked out, as nec-essary, at higher levels of management.

Although Joe Tapia was originally identified in.the OSP organization chart as part of the on-site team, it is our understanding that his loss to the Region could significantly affect required Regional inspections in the civil / structural area for other facilities. Accordirigly, we have redesignated this position as vacant and will fill it ir ::r. However, we may, on occasion, need to call upon Regional project and eng'...<ering inspection expertise. We will make these l
requests on a case-by-case basis.
We will continue to work with your staff to develop more definitive plans and schedules for the inspection support needed from Region IV.
