REVISED FEE SCHEDULE (FINAL RULE)

Enclosed for your signature is a Federal Register Notice amending 10 CFR Part 11 " Criteria and Procedures for Determining Eligibility for Access to or Control Over Special Nuclear Material" and 10 CFR 25, " Access Authorization for Licensee Personnel."

Currently, the regulations state that access authorization fees charged by NRC The final will be published in the Federal Register during July of each year.

Enclosed for your sig ature is a Federal Register Notice amending 10 CFR Part 11, " Criteria and Procedures for Determining Eligibility for Access to or Control Over Special Nuclear Material" and 10 CFR 25 " Access Authorization for Licensee Personnel."

This final rule would amend NRC regulations by informing NRC licensees of the adjustment to the fee schedule ~ publication in the Federal Register. Currently, the regulations state that access authorization fees enarged by NRC will be publishedintheFederalRegisterNuringJulyofeachyear. Since NRC's fees are wholly dependent on the background investigation rate charged by the Office l

of Personnel Management (OPM), a more, accurate and efficient regulatory require-ment would be to revise the fee schedule concurrent with OPM's notification to NRC of a revised background investigatiqn rate change. This rulemaking would j

delete the requirement to publish the fee schedule each July and keep the licensees infonned of current fees while ~a.t the same time decrease, to the fullest extent possible, unnecessary future NRC rulemaking requirements.

Congressional committees will not be informelhof this action. A public announcement will not be prepared.

Approval for Publication In a final rule published March 19, 1982 (47 FR 11816), the Commission delegated to the ED0 (10 CFR 1.40 (c) and (d)) the authority to develop and promulgate rules as defined in the APA (5 U.S.C. 551 (4)) subject to the limitations in NRC Manual Chapter 0103, Organization and Functions.

Office of the Executive Director for Operations, paragraphs 0213. 038, 039, and 0310.

The enclosed final rule, entitled " Access Authorization Fee Schedule Publica-tion for Licensee Personnel." will amend Parts 11 and 25 by informing licensees of the adjustment to the fee schedule publication in the Federal Register con-current with the Office of Personnel Management notification to NRC of a revised fee rate change.

This final rule does not constitute a significant question of policy, nor does it amend regulations contained in 10 CFR Parts 0, 2, 7, 8, 9 subpart C or 110.

I therefore find that this rule is within the scope of my rulemaking authority and am proceeding to issue it.
