Dear Mr. Brozovich:

~

This is to acknowledge receipt of your letter dated April 9,1986, transmitting correspondence from your constituent, Professor Zinovy V. Reytblatt.

This agency is currently defending a lawsuit brought by Dr.' Reytblatt in the federal district court in Chicago concernino the same matters

$ l'

, that are raised in his letter to Senator Dixon.f We have been

/ instructed by the AssTstant U.S. Attorney representing us in this case g h,g not to respond to any of Mr. Reytblatt's various attempts at i

< _comunication with this agency. I It would theref ore be inappropriate

/

for us to coment specifically on this correspondence, except to say that the NRC has evaluated Dr. Reytblatt's allegations on several d

,I occasions and each time has determined that the public health and safety is adequately protected by the existing NRC policies and hg practices regarding containment leak rate, testing.

ncerely.

i Dr. Reytblatt has also filed a 2.200 Petition concerning the Byron, LaSalle and Zion

reactors. My understanding is that the NRC is scheduled to respond on or about October 6,1986.

)

As I indicated in my letter to you of' August 5,1986, it is not my intention to prevent Dr. Reytblatt from correrponding with the NRC on matters outside the scope of this lawsuit. I believe that the list above underscores our attempts to keep the lines of communication open despite the pendency of this lawsuit.

Referring to Paragraph 7 of your motion in which you refer to a quote from an April 24, 1986, letter from Carlton Kammerer Director of NRC's Office of Con-l gressional Affairs, I have never spoken to Mr. Kammerer nor was he given this snecific instruction at my behest.

While the NRC will not respond to any information requests by Dr. Reytblatt within the scope of this lawsuit, the NRC will continue to address his requests on other, unrelated topics.

j Very truly yours, ANTON R. VALUKAS United States Attorney'
