HIGHLIGHTS ~0F WEEKLY INFORMATION REPORT WEEK ENDING FEBRUARY 27, 1987 Completion of the Moored Training Ship Denonstration Ceview 8

On February 20, 1987, NRR completed its review and issued the firel Safety Evaluation Report for the Moored. Training Ship Demonstration (MTSD), a-U.S.

Department of Energy /U.S. Department of Navy (DOE /NR) project to be used for training naval propulsion plant operators.

The MTSD's Safety Analysis Report was tendered on January 23, 1986. Du*ing the course of the review, the staff overcame approximately 7 weeks of an 11 week delay imposed by DOE /NR-and completed the review ahead of schedule. The' ACRS reviewed the project on Feb*uary 4 and 6, 1987. The ACRS's letter, dated February 11, 1987, concurs with tha staff's conclusions related to the opera-tion of the project.

Pre-Operational Inspection Sequoyah Fuels UF; to UF4 On February 18, and 19, 1987, representatives of NMSS, RIV, DOE (ORNL), and Westinghouse (Fernald, Ohio) participated in a pre-operational inspection of Sequoyah Fuels proposed depleted UF to UF facility in Gore, Oklahoma.

Areas inspected included process operations, ins,trumentation and computer control, 6

management organization, operator training and retraining, and radiation i

protection.

RIV assumed the lead and is responsible for reporting the activities and findings of the inspection team. Within the scope of the areas examined, no major items of concern were identified.

The inspection report is 4

expected to be completed by Mid-March 1987. The amendment application requesting authorization to process UF to UF was the subject of a Hearing in 6

4 January 1987.

As of this date, the Hearing' decision has not been rendered.

Meetina with Contractors On February 24, Division of Waste Management and Office of General Counsel staff met with Howard Bellman, Tim Mealy, and Matthew Low, to discuss the tasks they will be performing as contractors for the planned negotiated rulemaking on the development of procedures for the submission and management of records and documents related to the licensing of a high-level waste repository.

In contrast to conventional rulemaking where the agency develops the rule independently, negotiated rulemaking enables representatives of key interested parties, working under a mediator, to develop a proposed rule for agency approval. This approach to rulemaking is designed to save time by developing a rule that is more acceptable to all affected parties from the outset, and thereby reduce the need for resolving outstanding issues concerning the proposed rule. Mr. Bellman, a professional mediator, with support from Mr. Mealey and Mr. Low, will be working to convene the interested parties for the negotiations. The convening period, which involves identifying appropriate parties, determining their interest in participating in the negotiations, and assessing the feasibility for the NRC of proceeding t

with negotiated rulemaking, will end on May 15.

OFFICE OF NUCLEAR REACTOR REGULATION ITEMS OF INTEREST Week Ending February 27, 1987 River Bend Station On February 24, 1987, the Louisiana Public Service Commission (PSC) granted a

$57 million emergency interin rate relief to Gulf States Utilities, the River Bend licensee. The PSC acted after State courts had earlier romanded a $100 million emergency rate relief request to the PSC.

The Gulf States Utilities (GSU) service area includes southwest Louisiana and southeast Texas. On February 3, 1987, the Texas PSC awarded GSU a $39.9 million emergency. rate relief. However, granting this rate relief was con-tincent upon GSU establishing a $250 million line of credit. On February 5, 1987, GSU omitted dividends on their preferred stock. GSU had earlier omitted dividends on thair common stock.

NRC TMI-2 CLEANUP PROJECT DIRECTORATE WEEKLY STATUJ REPORT FOR FEBRUARY 23 - MARCH 1, 1987 1.

DEFUELING Fuel removal activities resumed on February 23, 1987. The principal work effort was focused on removal of end fittings and fuel pins-from the peripheral fuel assemblies. The efforts were largely successful but a few end fittings were deforr:ed such that they would not fit in the canister opening.

ENVIRONMENTAL MONITORING US Environmental Protection Agency (EPA) sample analysis results show that TMI site liquid effluents are in accordance with regulatory limits, NRC requirements, and tha City of Lancaster Agreenent.

TMI water effluents are sampled from the station (Units 1 and 2) discharge and analyzed by EPA. Gamna spectrun analyses of the seven daily composited samples for Fahruary 7 - 14, 1987 indicated no TMI-2 related radioactivity.

EPA's ganma spectrum analysis of the NRC's TMI outdoor air sample for the period February 19 - 27, 1987 showed no reactor related radioactivity.

The Lancaster water works intake composited seven daily samples February 8 - 14, 1987. The gamma spectrum analyzed by EPA showed no reactor related radioactivity.

DECONTAMINATION ACTIVITIES Scarifying of the reactor building basement walls continues.

Robotic scabbling of the seal injection cubicle has been delayed because of high radioactivities in the debris.

MEETING The Advisory Parel for the Decontamination of Three Mile Island Unit 2 net on February ?6,1987 at the Lancaster City Council Chambers, Lancaster, PA. The NRC and GPU Nuclear staffs responded to questions posed by the Parel and the public on the NRC's Draft Environrantal Impact Statement (EIS) for the Disposal of Accident-Generated Water -

The Panel listened to statemerts by.nenbers of the public regarding the licensee's proposed disposition of the accident-generated water.

The next Advisory Panel meeting is tentatively scheduled for March 25, 1987, in Harrisburg PA. The meetirg will include further discussion of the proposed disposition of the accident-generated water and the NRC's Draft EIS and will include an opportunity for public conment. The exact date, time, and location of the maeting will be announced in the futura.

l OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending February 27, 1987 Meetino on large Irradiators On February 24, 1987, the staff met to discuss regulatory requirements for large irradiators.

Representatives attended from NMSS, SP, AEOD, RES, and Region I, II, III, and IV. The meeting was prompted by an expected increase in irradiator license applications, due to interest in food irradiation and planned Department of Energy sponsorship of several irradiators.

All aspects of irradiators were discussed including siting, design, operator training, and safety procedures. There was a general consensus that our licensing guidance for irradiators needs to be expanded, and that NRC should consider developing a regulation for irradiators, similar to 10 CFR Part 34 for radiography.

NHSS will follow-up on the results of the meeting.

Combustion Engineerina (Windsor, Connecticut Facility, Docket 70-1100)

Representatives from Combustion Engineering (CE) and NRC met on February 19, 1987, to discussythe NRC preliminary review of CE's application requesting authorization to base nuclear criticality safety on the maximum mist density of water from a sprinkler system in a particular area of the facility.

Additional requirements related to the method of analysis used, engineering and administrative controls required, and the adequacy of safety margins were included in the discussion.

CE plans to submit a revised application addressing the NRC concerns regarding the inadequacies of its present submittal.

Sequoyah Fuels UF to UF Pre-Operational Inspection g

2 Licensing Support System The NRC has submitted to DOE a draft Agreement in Principle, signed by the i.

Director, Office of. Nuclear Material Safety and Safeguards, which sets forth the policy and. respective commitments of the two agencies for prompt development of a Licensing Support System for high-level waste repository.

The Li*ensing Support System is an automated record management licensing.

c system for the high-level waste licensing proceeding.

The objective of the Licensing Support System will be to facilitate compliance with the three year schedule for a Commission decision on a DOE application to authorize repository construction under Section 114d of the Nuclear Waste Policy Act.

The full nature and scope of the system will be defined by NRC's current negotiated rulemaking efforts.

The Division of Waste Management has developed a Transitional Licensing

. Support System (TLSS) for the high-level waste licensing proceeding.

The TLSS is NRC's " interim" automated high-level waste record management system until

- such time as the DOE Licensing Support System becomes operational.

The Division of Waste Management will be meeting with DOE, the States and Tribal organizations on March 25, 1987 to discuss DOE's efforts for developing the Licensing Support System.

The meeting is to identify issues for the forthcoming negotiated rulemaking and to demonstrate the interim NRC system.

Advanced Notice of Proposed Rulemaking On September 30, 1986,. the Environmental Protection Agency published an Advanced Notice of Proposed Rulemaking about primary drinking water regulations for radionuclides [51 FR 34836].

The notice states that EPA is considering establishing Maximum Contaminant Level Goals (MCLGs) for radionuclides in drinking water under the Safe Drinking Water Act.

The notice indicates that EPA may establish MCLGs of zero for radium-226, radium-228, gross alpha, uranium, radon, and gross beta and photon emitters. Although the notice states that MCLGs are non-enforceable health goals, E.A is required to establish enforceable Maximum Contaminant Levels as close to the MCLGs as feasible considering cost and technology.

Such low limits for drinking water may have direct and indirect implications for NRC regulatory programs such as

-the ongoing revisions to 10 CFR Part 20, guidance on Alternate Concentration Limits for uranium recovery facilities, and other licensing and regulatory activities. The notice also proposes the following definitions:

" Natural Uranium" means uranium with combined uranium-234 plus uranium-235 plus uranium-238 which has a varying isotopic composition but typically is 0.006% uranium-234, 0.7% uranium-235, and 99.27% uranium-238.

" Man-made beta particle and photon emitters" means all radionuclides emitting beta particles and/or photons except thorium-232, uranium-235 and uranium-238 and their progeny.

0FFICE OF NUCLEAR REGULATORY RESEARCH Itent of Interest Week Ending February 27, 1987 Sixth Cocrdination Meeting on Containment Performance Research Under Severe Accidents The 6th coordination meeting was held on Tuesday, February 24,1987, at the Phillips Building in Bethesda, Maryland, to present results and discuss upcoming tests scheduled as part of research programs related to containment performance. The meeting was attended by representatives from NRC/NRR, RES, Sandia, Ames, and Battelle laboratories.

Presentations were given on contairment test programs; studies on containment venting, direct heating and integrity under high seismic loads.

NUREG 1150, " Reactor Risk Reference Document" was also presented. Copies of presentations can be obtained by contacting H. Graves, 443-7862.

Graves Maine Yankea Seismic Margins Review Om February 19, 1986, the conclusions of the Maine Yankee Seismic Margins Review was presented to the NRC Seismic Design Margins Working Group and other NRC staff members. The Maine Yankee Peer Review Group also presented their final assessment of this review. Despite a number of itmes needing clarification in the draft final report, the review itself is felt to have been very successful and will be the primary input into an SER on Maine Yankee seismic design issues.

OFFICE OF STATE PROGRAMS ITEMS OF INTEREST WEEK ENDING FEBRUARY 27, 1987 Low-Level Waste The National Governors' Association, at its winter meeting February 22-24, adopted the following resolution proposed by New Jersey: Resolved that the Congress should direct the Department of Energy to immediately sponsor a study by the National Academy'of Sciences to establish safe, and to the greatest extent possible, site-independent facility designs for low-level waste; and further that the Academy should survey existing practices and scientific databases with respect to compaction, pact: aging, volume reduction, containment, and classification of wastes.

State Task Force on Nuclear Safety The National Governors' Association also established a task force on Nuclear Safety as a sub unit under its Committee on Energy and the Environment. The mission of the task force shall be to examine two issues:

first, the relationship among the States, the Federal Government, and the utility industry in ensuring the safe design and operation of nuclear power units; and second, the relationship among the States, the Federal Government, and the utility industry in ensuring off-site emergency response. The task force was charged with developing consensus policy recommendations and reporting them to the full Committee in -time for consideration at the 1987 NGA annual meeting in late July.

The Task Force consists of Governor Arch Moore (WV), Chairman of the Committee; Governor Cecil Andrus (ID), Chairman of the Task Force; Governor Booth Gardner (WA); Governor Richard Celeste (OH); Governor Madeleine M. Kunin (VT); Governor James G. Martin (NC); Governor Garrey Carruthers (NM); Governor Carroll A. Campbell, Jr. (SC); Governor James Thompson (IL); Governor Mario M. Cuomo (NY); Governor Michael Dukakis (MA);

Governor John H. Sununu (NH).

The one-day workshop acquaints attendees with the NRC Incident Investigation Program and provides a status report on the Perfomance Indicator Program. The last workshop will be held on March 11, 1987 in Region V.

- SECY to V. Stello dated 2/26/87 The Commission was briefed on the lessons learned from the Chernobyl accident and the staff's evaluation of the regulatory implications.

Chairman Zech requested the staff to resubmit the attachment to SECY-87-25 with editorial changes by Friday, February 13, 1987.

(Subsequently, on February 13, 1987, the EDO resubmitted NUREG-1251 to the Commission.)

Commissioner Asselstine requested the staff to inform the Commission of nuclear installations which share systems between units as part of their shutdown capability.

The Commission also requested the staff to review in more detail containment venting systems and filtering and their associated cost and benefit.

The Commission also encouraged the staff to carefully review our operator training and education requirements end determine if the Soviet experience from the Chernobyl accident could shed light on improving our training requirements.

Commissioner Carr urged the staff to provide fire departments, that may be called upon to combat fires, and nuclear pcwcr plants with the appropriate lessons learned from the Chernobyl fire on a continuing basis.

Commissioner Asselstine requested the staff to determine if it can clarify what makes plants like Ginna and Millstone have successful maintenance programs while other plants, such as Peach Bottom and Salem have less successful programs.

The staff committed to update the Commission if, in recent months, there has been a reduction in the backlog of maintenance items, including equipment out of service, at Fermi.

The Commission requested that, at the next briefing by the regional administrators, the staff highlight meritorious initia-tives by licensees as well as lessons learned from plants which have received high SALP ratings.

Commensurate with the level of detail of the information sub-mitted by DOE, the staff committed to explore with DOE the licensing and regulatory issues associated with the LMR fuel cycle (especially fuel reprocessing) to determine the need for requirements important for the licensing of these reactor designs.

There were no requirements set on the staff at this meeting.

SECY-86-380 - Material Control and Accounting Requirements for Facilities Licensed to Possess and Use Formula Quantities of Strategic Special Nuclear Material The Coimnission, by a vote 5-0 vote, approved amendments to 10 CFR' Parts 70 and 74 and authorized publication of the final rule in the Federal Register, subject to the modifications noted on.

Commissioner Asselstine noted that:

it would seem that the intent of $74.51(d) (2) in requiring bimonthly tests during the initial phases of implementing the new FNMC plan is to serve as a check on the workings of the new plan.

However, 374. 51 (c) (2) does not require implementation of the plan until 90 days following staff approval.

Therefore, the requirement of 574. 51 (d) (2) for bimouthly inventories for six months following staff approval of the plan may result in only one physical inventory to serve as the check.

This would seem to be an insufficient test of those licensees that have littJe or no experience with process monitoring for safe-guards purposes.

I believe a minimum of three bimonthly inventories should be required for such licensees."

The revised rule should be forwarded for signature and publication in the Federal Register.

SECY-87 October 20, 1986 Order to Show cause--Northern States Power Company The Commission, by a'3-2 vote, approved an order in the matter

.of Northern States Power Company which directs the NRC staff to file with the Commission and serve on petitioners and licensees a detailed explanation of the health and safety basis for the October 20, 1986 show cause order issued by the staff.

Chairman Zech and Commissioner Carr disapproved;the order. 'They believe that the enforcement process should take its normal course by assigning an Administrative Law Judge or Hearing Board to conduct the requested hearing.

III.

SECY-86-348 - Final Rulemaking for Revisions to Operator Licensing - 10 CFR 55 and Conforming Amendments The Commission, by a 5-0 vote, approved publication of final rules on operator licensing which revise.10 CFR 55, 10 CFR 50 and three associated regulatory guides.

The Commission (with Chairman Zech and Commissioners Asselstine and Carr agreeing) also approved Option A of the EDO's January 5, 1987, memorandum, as modified by Commissioner Carr.

Option A

as modified would require the NRC to examine all licensed operators on a random basis so that no operator will go longer than'six years without being examined by the NRC once an initial six year license is issued.

Commissioner-Bernthal would have combined tWb elements of Option A and B in-the rule to indicate that the Commission would examine operators every six years

unless the licensee demonstrates the ability to conduct a high quality exam program.

Commissioner Roberts did not approve Option A, he would have preferred Option C which would continue with the present prcgram of limited NRC requalification exami-nations to evaluate licensees requalification programs.

Commissioners Asselstine and Bernthal would also have required plant-referenedd simulators.

Commissioners Asselstine and Bernthal will have additional views to be published with the rule.

You should revise the final rule to include Option A, modified to indicate that the Commission will administer requalification written examinations and operating tests on a random basis so that no operator will go longer than six years without being examined by the'NRC.

The attached editorial changes to pages 1, 2, 19, 29, 30, 31 and 45 should also be incorporated.

The revised rule should be forwarded for signature and publication in the Federal Register.
