Dear Mr. Carpenter:

AH This letter is in further response to your May 1, 1987 Petition filed on behalf

==

of the Government Accountability Project (GAP) and others. By letter dated f

June 8, 1987, I acknowledged receipt of your Petition and denied the immediate relief that you requested. At that time, I indicated that your Petition had y

been referred to the staff for consideration pursuant to 10 CFR 2.206 of the

  1. i Comission's regulations and that, as provided by Section 2.206, action would d l be taken on your request within a reasonable time. By letter dated October 1, p

1987, I provided the status information you sought regarding your Petition and 2

enclosed two reports germane to your requests: NUREG-1250, "Report of the 4

Accident at the Chernobyl Nuclear Power Station,' published in January 1987, "I

and Draft NUREG-1251, "Implications of the Accident at Chernobyl for Safety e

Regulation of Comercial Nuclear Power Plants in the United States," published e

in September 1987 for public coment.

In your Petition, you requested that the NRC suspend further licensing of nuclear facilities in the United States pending completion of a study and report of the accident at the Chernobyl nuclear reactor. Additionally, you requested that the NRC review the findings of the report for their applicability to facilities 4

licensed by the NRC, request public coments, and evaluate the need for the q

corrective actions you identified in your Petition. The staff has concluded its evaluation of the information and requests contained in your Petition. As discussed in the enclosed "Director's Decision Under 10 CFR 2.206," the staff 7

has completed a study and prepared a final report of the Chernobyl accident, and y

has reviewed the findings of that report for their applicability to currently e

licensed facilities or facilities under construction. Accordingly, to the

(

extent that the Petition requests that the staff undertake such a study and review, those requests have, in effect, been granted. For the reasons stated in the enclosure, the additional relief requested in the Petition is denied.

I have also enclosed a copy of a notice that is being filed with the Office of W;

the Federal Register for publication.
