l' NOTICE OF VIOLATION Duke Power Company Docket Nos. 50-269, 50-270, and 50-287 Oconee, Units 1, 2, and 3 License Nos. DPR-38, DPR-47, and DPR-55 During the Nuclear Regulatory Comission (NRC) inspection conducted on October.15 -

November 10,1986, a violation of NRC requirements .was identified. In accordance with the " General-Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1986), the violation is listed below:

Technical Specification 3.4.5 requires that the Reactor Coolant System shall not be heated above 250 degrees Fahrenheit unless the Emergency Condenser Cooling Water (ECCW) system is operable. It also requires that if the ECCW system becomes inoperable during operation above 250 degrees Fahrenheit and if the system is not restored to operable status within seven days,-then the unit shall be brought to hot shutdown within an additional twelve hours and below 250 degrees Fahrenheit within another twelve hours.

Contrary to the above, for periods in 1978, 1981, and 1986 when the Lake Keowee elevation was less than 792 feet, the ECCW system was inoperable and unable to provide sustained siphon flow through the main condenser during a station blackout during plant operation above 250 degrees Fahrenheit, and the system was not restored to operable status within seven days or brought to hot shutdown within an additional twelve hours.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is.hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been.taken and the results achieved, (4) the correc-tive steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
