SUBJECT:
EDO APPROVAL OF AMENDMENT TO PART 110 This memorandum seeks EDO ' approval, in accordance with ED0 memorandum of May 30, 1984, for the staff to proceed with an amendment to 10 CFR Part 110.
The amendment is necessary to implement Public Law 99-440, the Comprehensive Anti-Apartheid Act of 1986,' which entered into force on October 2 and inooses a wide range of sanctions ag'ainst South Africa.
Section 309(a) of that Act,
" Prohibition on Importation of Uranium and Coal from South Africa",
specifically prohibits the import into the United States of uranium ore and uranium oxide that is produced or manufactured in South Africa.
Currently, 110.27 permits the import of unirradiated source or special nuclear material, including uranium ore and uranium oxide, from any country if the consignee in the United States is authorized to nossess the material.
e The amendment to Part 110 would revise 110.27 to delete the general license to import source or special nuclear material contained in uranium ore and uranium oxide produced or manufactured in South Africa.

In accordance with that Act, Section 309(a) takes effect 90 days.after the enactment of the Act or on January 1, Ic87. Therefore, the amendment to Part 110 should be published on a priority basis as a final ruin effective January 1,1987.
There are no alternatives to the rulemaking action. A copy of the draft regulatory agenda entry is enclosed.
In accordance with EDO memorandum of May 30, 1984, your approval is requested to proceed with staff processing of the amendment.

10 CFR 110 ABSTRACT:
The rule'would implement Public Law 99-440, the Comorehensive Anti-Apartheid Act of 1986, which imposes a wide range of sanctions against South Africa. Section 309(a) of that Act, " Prohibition on Importation of Uranium and Coal from South Africa", specifically prohibits the import into the United States of uranium ore and uranium oxide that is produced or manufactured in South Africa.
NRC's general license for imports in 5110.27 now permits the import of unirradiated source or special nuclear material, including uranium cre and uranium oxide, from any country if the consignee in the United States is authorized to possess the material. The amendment to Part 110 would revise 5110.27 to delete the general license f,or import of South African-origin source or special nuclear material contained in uranium ore and uranium oxide.
