Gentlemen:

SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT NO. 50-400/86-92)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

W. Tobin on December 1-5, 1986. The inspection included a review of activities

authorized for your Harris facility. At the conclusion of the inspection, the

findings were discussed with those members of your staff identified in the

enclosed inspection report.

Areas examined during the inspection are identified in the report. Within these

areas, the inspection consisted of selective examinations of procedures and

representative records, interviews with personnel, and observation of activities

in progress.

The inspection findings indicate that certain activities appeared to violate NRC

requirements. The violations, references to pertinent requirements, and elements

to be included in your response are described in the enclosed Notice of

Violation.

Reference - is also made to our telephone conversation on December 11, 1986,

l. between J. Willis, Plant General Manager and P. Fredrickson of my Division of

l Reactor Projects. The NRC Enforcement Policy normally allows for escalated

l enforcement action for incidents of failure to control access to vital areas;

however, I have concluded that a Severity Level IV is mua appropriate in this

case because of the operational status of your facility at the time (Mode 6) and

l

h resultant lack of safety significance to the public. During our conversation

I

of December 11, we expressed our concern about the implementation of your

Physical Security Program specifically as it relates to vital area access control

( and alarm station operators strict adherence to their procedural duties. In your

'

response, you are requested to address these issues and the measures you have

taken to' ensure nonsecurity employees and their supervisors are sensitive to

l their security-related responsibilities.

Your - attention is invited to unresolved items identified in the inspection

report. These matters will be pursued during future inspections.

security measures are exempt from public disclosure; therefore, the enclosures to

this letter, with the exception of the report cover page which presents a

nonexempt summary, will not be placed in the NRC Public Document Room.

The responses directed by this letter and its enclosures are not subject to the

clearance procedures of the Office of Management and Budget as required by the

Paperwork Reduction Act of 1980, PL 96-511.
