SUMMARY

OF MEETING ON SEPTIMBER 22, 1988 - CPSES Uh!T 1 TECHNICAL SPECIFICATIONS NRC staff and representatives of TU Electric met on September 22, 1988 in Rockville, Maryland to discuss the CPSES Unit 1 Technical Specifications (TS) which are under development. The meeting notice, agenda, and list of attendees are provided as Enclosures 1, 2, and 3, respectively to this summary.

Unreviewed Generic Changes During the first part of the meeting, the staff provided feedback in response to the TV Electric letter of August 5,1988 (TXX-88605) in which TU Electric prioritized and summarized 64 unreviewed generic changes which it has proposed to the Unit 1 TS (see Attachment 1 to Enclosure 2). (The staff had previously indicated that it considered these proposed changes "generic," that is, the changes appeared to be of the sort that could be applied to any four-loop Westinghouse pressurized water reactor and did not appear to be Comanche Peak design-specific.) Mr. Giardina, the staff reviewer from 0758, highlighted 36 items on the list which the staff would consider for further review. Mr.

Butcher, Chief of 0TSB, informed the applicant that his branch would not normally agree to the changes proposed by the remaining 28 items during any TS review.

The 36 items designated for further review can be grouped into 3 categories.

Mr. Butcher made some general comments on the NRC categorization and ,

prioritization. Whereas the applicant assigned priorities based on a l subjective weighing of various operational factors, Mr. Butcher stated that

' l the staff bases its priorities first on safety and secondly on gaining  ;

standardization. He also commented that NRC does not have unlimited resources to devote to an individual plant's TS review.,

1 It was agreed that several working meetings were necessary in order to make progress towards the issuance of the "Proof and Review" version of the Unit i TS by the end of the year. Within the next two weeks, the staff and applicant will set up a two-day meeting to review the generic changes list and identify the information TU Electric needs to provide for further staff review of the items in NRC Categories 2 and 3. At the same time, the Category 1 items will be examined to identify to what extent the staff work in progress J envelopes the items in this category.

TS Changes Responsive to the Joint Stipulation The applicant proposed changes to Section 6.0 of the Unit 1 TS to reflect one of l the provisions of the Joint Stipulation reached between the applicant, 1 intervenor (Citizens Associated for Sound Energy), and the NRC staff which formed the basis for the July 1988 dismissal of the Comanche Peak operating 4 license proceedings before the Atomic Safety and Licensing Board (see Attachment 2 to Enclosure 2). The applicable provision provides for the appointment of Mrs. Juanita Ellis of the Citizens Association for Sound Energy  !

or her designated alternate, to serve on the Comanche Peak Operations Review l Comittee for a specified period of time. The staff and applicant discussed l

the wording of the proposed TS changes. It was agreed that these changes i j should be discussed further at a future TS working meeting.  !

It was agreed that the logistics for submitting additional changes and/or additional information prior to completion of the "Proof and Review" version j of the Unit 1 TS will be deferred until the need for specific submittals is identified.

As you are aware, TV Electric is in the process of developing Technical  !

3 Specifications for CPSES Unit 1. These Technical Specifications are based on

! the latest NRC draft of the Westinghouse Standard Technical Specifications ,

(STS) as provided by the NRC on August 14, 1987. CPSES proposed changes to '

j this document can be categorized as follows:

1) Changes which are plant-specific, and [

] 2) Changes which are generic and improve the STS. l I

In an effort to enhance the Technical Specifications from the user's  ;

i perspective, certain specifications or portions of specifications have been l l proposed for relocation from the CPSES Technical Specifications to programs  !

described in Section 6.8 of the CPSES Technical Specifications. These (

programs, which represent many of the generic changes, involve 1 The CPSES Fire Protection Report, 2 The Radioactive Ef fluent and Environmental Monitoring Manual, and 3 The CPSES Technical Specification Improvement Program.

i l Three programs were chosen, in lieu of a single program, due to minor variations in the administrative controls to be applied to each.

The NRC and the nuclear industry have recently recognized the benefits of improved Technical Specifications and ef forts are currently underaay to develop and implement nea Standard Technidal Specifications which are reflective of this philosophy. Since these new Standard Technical 1 Specifications are not yet available. TV Electric has no choice but to proceed with development of the CPSES Unit 1 Technical Specifications based on the l NRC's latest draft STS. Based on our past submittals, it should be clear thit the number of CPSES improvements is small compared to the nea STS improvements being developed by industry, i

Page 2 of 2 The NRC staff position on the CPSES Technical Specification improvements was submitted to TV Electric by the the referenced letter. This letter indicates the NRC will consider specific areas of change within the improvement program,  ;

but maintains prioritization of the changes is a prerequisite to NRC review.

Attachment A provides a summary of all unreviewed generic changes to the CPSES Technical Specifications. A prioritization of the changes has been made.  :

1 However, since all CPSES generic changes are of nearly equal importance, an l essentially arbitrary assignment has been made for the majority of the changes. Also, a listing of poner' plants has been made in cases where the t CPSES change, or a similar change, has been previously approved by the NPC. ,

Since a lead plant already exists for the majority of these changes, review resource requirements should be substantially reduced.

TV Electric intends to follow the development of the new Westinghouse STS closely. This document will be examined for implementation at CPSES when it is accepted by the NRC. Based on the CPSES Unit i schedule and potential delays in the generic program, there is a high probability that implementation of the new STS (including procedure development, operator training, etc.) will not be possible prior to licensing CPSES Unit 1. In the interim, TV Electric l must pursue its commitment to safety by seeking the best possible Technical Specifications for CPSES Unit 1. NRC review and acceptance of the Technical Specification changes proposed by TV Electric will contribute to the safe operation of CPSES Unit 1 by providing the clear, concise, and correct directives that our operators need.

TV Electric will contact the NRC staff soon to ascertain the schedule for revien of the specific changes as prioritized in Attachment A.

This update is reflective of a recent agreement between TV Electric, the Citizens Association for Sound Energy (CASE), and the NRC (Reference 2), as aCCeDted by the Atomic Safety and Licensing Board on July 5, 1988 (Reference 3). The CPSES FSAR (Section 13.4) will be updated in a future amendment to ma- .ain consistency with the attached Technical Specification sections.

h. Quality assurance praetices.

The ORC shall report to and advise the Executive Vice President, Nuclear Engineering and Operations on those areas of responsibility specified in Speci fications 6.5.2.7 and 6.5.2.8.
