Gentlemen:

SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT NOS. 50-259/86-38,

50-260/86-38, AND 50-296/86-38)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

R. E. Weddington at the Browns Ferry facility on October 15-17, 1986. The

inspection included a review of the circumstances surrounding the apparent loss

of five fission counters. An Enforcement Conference was held on November 4, 1986

at your facility during which the loss of the fission counters, associated

violations, causes and your corrective actions were discussed.

The violations described in the enclosed Notice of Violation involved the failure

to adequately account for and control five fission counters containing 10 grams

of enriched uranium-235, and to comply with transportation and disposal require-

ments for the special nuclear material. The NRC concludes that these violations

collectively indicate a weakness of your management controls in the area of

special nuclear material control and accountability.

In accordance with the " General Statement of Policy and Procedure for NRC

Enforcement Actions, "10 CFR Part 2, Appendix C (1986) the violations described

in the enclosed Notice have been categorized in the aggregate as a Severity

-Level IV problem.

In addition to the need for corrective action regarding the specific matters

identified in the enclosed Notice, we are concerned about the implementation of

your management control systems that permitted this situation to develop.

Consequently, your response should describe those particular actions taken or

planned to improve the effectiveness of your program.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response.

In your response,

you should document the specific actions taken and any additional actions you

plan to prevent recurrence. After reviewing your response to this Notice,

including your proposed corrective actions, the NRC will determine whether

further NRC enforcement action is necessary to ensure compliance with NRC

regulatory requirements.

The responses directed by this letter and its enclosures are not subject to the

clearance procedures of the Office of Management and Budget as required by the

Paperwork Reduction Act of 1980, PL 96-511.
