TRANSFER OF COMANCHE PEAK TRANSCRIPTS TO THE OFFICE OF INVESTICATIONS Enclosed are copies of transcripts of interviews of Mr. Don Nisich, a former Brown and Root employee at Comanche Peak. The first transcript is of an interview conducted August 8, 1984, and is transmitted in accordance with my memo of August 10, 1984 The second and third transcripts are of interviews of Mr. Nisich conducted on August 23, 1984.

Dear Secretary Donovan:
Pursuant to the Atomic Energy Act as amended, 42 U.S.C. 5851 and 29 C. F. R. Pa rt 24, Mr. Donald Nish hereby files this complaint with the Secretary of Labor. Mr. Nish alleges that on or about July 17, 1984, he was discriminated against in the terms, conditions and privileges of his employment by the Brown and Root, Inc. , Glen Rose, Texas, for whom he worked until July 13, 1984 as a Quality Control Inspector at the- ;
Comanche Peak Nuclear Power Plant under construction in Glen Rose, Texas.
While employed by Brown and Root at Comanche Peak, Mr. Nish brought a series of violations of Nuclear Regulatory Commission ("NRC")
regulations to the attention of his supervisors and others. As'a result of his pursuit of these violations, Mr. Nish was subjected to several incidents of intimidation and harassment.
On or about July 2,1979, Mr. Nish was hired by Brown and Root and given a position at the South Texas Project. On or about February 1982, Mr.
Nish was assigned to the Comanche Peak site. While at both sites, Mr.
Nish repeatedly refused to violate NRC regulations. He also brought violations to the attention of his supervisors by viriting Non-Conformance Reports ("NCR") and verbally informing them of the violations. Mr. Nish also questioned the leadership that was being provided at the Comanche l Peak site and the qualifications of several individul workers based on i his 15 years of experience in the nuclear field.
As a result of these activities, Mr. Nish was transferred from his job as a QC Inspector and assigned to the the N-5 Group. Subsequently, he was placed on a special assignment which required that he perform duties specifically prohibited by his personal physician. In addition, Mr. Nish has been subjected to arbitrary and capricious shif t changes.

' August 10, 1984 Mr. Nish hereby requests relief from the illegal discrimination which has caused him financial hardship, anxiety and damage to his professional reputation.
The relief Mr. Nish requests includes an abatement of the discriminatory termination, compensatory damages and legal fees as well as all other relief to which he is legally entitled.
Mr.
Nish reserves the right to add items to the complaint as they occur and come to his attention.
