SUBJECT:
COMANCHE PEAK STEAM ELECTRIC STATION:
ALLEGED THREAD OF "BLACKEALLIhG" 0F A QUALITY CONTROL INS;ECTOR REPORT NUMBER: 04-84-037 On August 8, 1984, Don NISICH a former Brown & Root, Inc. (B&R) Quality Control (0C) Inspector at the Comanche Peak Steam Electric Station (CPSES),
was interviewed by membars of the Technical Review Team (TRT) for the CPSES in Stephenville, Texas Present at this interview were Elroy GAITIN, a Government Accountability Project (GAP) representative, anc Meddie GREGOR) an NRC confidential source and f.ormer B&R QC inspector at the CPSES.
INVESTIGATOR'S NOTE:
Tne contents of the transcript, Exhibit 1, taken during this interview indicates that Meddie GREGORY has a continuing dialogue with NISICH.and other GAP witnesses recarding the contents of her original statement to the NRC GREGORY's activities in behalf of GAP bring into question her intentions regarding maintaining the confidentiality she requested and received from the NRC.
NISICH stated during his interview with the TRT members that a Brown & Root neadquarter's employee by the name of Al SMITH visited him in Stephenville following his NISICH's termination.
NISICH. alleged that during this interview, SMITH warned him that if he were to become a " whistle blower" and go to one of the intervenor groups or the NRC, it could adversely affect his future career in the nuclear industry (Exhibit 1, page 12 and 13).
NISICH also related an incident involving his writinn of nonconformance report iNCR) no. M13932 during his participation in the N-5 Ouality Review group N!SICH stated he was instructed by his supervisor, Greg BENNETZEN. to write this NCR which related to incomplete documentation received by the group.
NISICH alleged that as a result of his NCR, he was taken out of his position with tha h-5 group and put on special assignment in a down-graded job.
NISICH said he was subsequently put back in his original position.
NISICH alleged the changes made in his work assignment during this period were the result of his findino too many errors in the paperwork which he identified to his supervisors.
NISICH said Bob SEIVERS. a supervisor, subsequently voided the NCR.
NISICF also referred to a gouge in a stainless steel pipe in isometric drawing ne. VA2A5 and an NCR he wrote on the couge in September 1983 NISICH alleged that supervisors Ted NEELY and Greg FANNING had pressured him to sign off the dispsiticr. of tne NCR on this flange.
NISICH said he successfully resisted their pressure because the finci dirensions for the flange were not complete (Ex loit 1, pages 28-35).
Or. August 23, 1984, Don NISICH was again interviewed by members nf the TRT and tnis reporter regarding ris allega:icns of intimidation.

JO NOT J SC OSE interview witt NISICE he detailed the following conditions which he characterized as intimidation and harassment during his employment at the South Texas Project (STP) and the CPSES, Exhibit 2:
1.
He was reassigned from the N-5 group and subsequently returned to the N-5 supra (page 4).
2.
Less qualified co-workers were promoted above him at the STP (sage 5).
3.
NCRs he had written against engineers at STP were held against him (page 5).
4.
The fact he knew too much about STP (page 7).
5.
CPSES supervisors did not like him because he did his job correctly (page 7).
6.
Wayne MANSFIELD. a supervisor, said he was working too slow despite his NISICH's explanation that he had health problems (page 11).

Jeff PILAND, a Brown & Root, Inc. Quality engineer, asked him to sign off on a weld data card for welds that he had not inspected.
NISICH explained tc PILAND that he had not inspected these welds.
PILAND and Pnug SNOW explained to him why it was proper for him to accept these vendor welds, but he NISICH refused to co so (page 21).

NISICH was asked to sign off a disposition or, an NCR on a flange that did not have the final dimensions listed, supra.
NISICH characterizec Al SMITH's statements (supra) as a warning of the potential consequences if his participation in making allegations were known in the nuclear industry.
NISICH said that he dad not perceive SMITH's statements as a threat (page 37).
NISICH's allegations of intimidation is additionally addressed in 01 Re: ort of Inquiry No. Q4-84-035.
This inquiry is closed, and NISICH's testimony is provided to the Region IV staff for proper evaluation, analysis, and ar action deemed appropriate.
