Dear Mr. Denton:
My letter of May 15, 1986 (as supplemented via letters dated May 23, June 6, June 30, and July 10, 1986) submitted proposed McGuire 1/ Cycle 4 0FA Reload license amendments to Facility Operating Licenses NPF-9 and NPF-17 for McGuire Nuclear Station, Units 1 and 2, respectively. This submittal was subsequently revised / supplemented by my letter of August 4,1986 as a result of a core redesign necessitated by fuel assembly problems discovered during the current refueling outage. The revised / supplemented submittal justifies operation with the redesigned core and the additional proposed technical specification changes, as i
well as the continued acceptability of the previously proposed technical i
specification changes. The " Notice of Consideration of Issuance of Amendment to Facility Operating License and Proposed No Significant Hazards Consideration Determination and Opportunity for Hearing" related to the revised / supplemented submittal was published in the Federal Rekister on August 7, 1986.
4 The above referenced revised / supplemented submittal indicated that a revision to I
the previously submitted (reference my May 23 and June 6,1986 letters) peaking factor limit report for McGuire Unit 1/ Cycle 4 (which is required in accordance with Technical Specification 6.9.1.9) would be necessary, with the revised report to be submitted by August 12, 1986. However, subsequent evaluation of the Unit 1
1/ Cycle 4 core redesign has verified that the original peaking factor limit report remains applicable to this cycle, and consequently no revision is necessary.
Also, Attachment 2 of the August 4, 1986 submittal erroneously stated that McGuire Unit I has been operated with a water hole in an assembly (the IFM demonstration assembly, ZV-1) during the 2 previous cycles. While this demonstration assembly i
has been in the core during the 2 previous cycles (i.e. since Cycle 2), it has i
only contained the one open water channel for the last cycle (i.e. during Cycle 3) i no\\

Please be advised that the end of Cycle 3 refueling outage schedule provided in the August 4,1986 submittal has been revised, with Cycle 4 startup (criticality date) now currently planned for August 23, 1986 (previously scheduled for August 26, 1986). llthough this schedule entails a shorter review / approval period than originally anticipated for the revised / supplemented submittal, it should still be possible to grant the amendments under the exigent license amendment provision of 10CFR 50.91(a)(6) as requested in the August 4, 1986 submittal. Duke Power will continue to keep the NRC apprised of any changes to this schedule. Should there be any questions concerning this matter or if additional information is required, please advise.
