l ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket Nos. 50-369, 50-370 McGuire License Nos. NPF-9, NPF-17 During the Nuclear Regulatory Comission (NRC) inspection conducted on March l
23-27, 1987, a violation of NRC requirements was identified.
The violation involved failure to provide the required annual emergency response training to three members of the emergency organization.
In accordance with the " General

Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, AppendixC(1986),theviolationislistedbelow:
j 10 CFR 50.54(q) requires that a licensee follow and maintain in effect emergency plans which meet the requirements of Appendix E of 10 CFR Part 50 and the planning standards of 10 CFR 50.47(b).
Section 0 of the McGuire Emergency Plan states that annual retraining will be l
required for all primaries and alternates assigned to the Tcchnical i
Support Center and Operations Support Center.
This annual retraining provides guidance to members of the McGuire Nuclear Station for their role in the overall crisis management philosophy in coping with plant emergencies.
Contrary to the above, on March 25, 1987, the hRC inspector reviewed selected emergency response personnel training records and ietermined that three individuals assigned to the Technical Support Center had not received the annual retraining for emergency response personnel, i

achieved, (4) the corrective steps which will be taken to avoid further j
violations,and(5)thedatewhenfullcompliancewillbeachieved. Where good cause is shown, consideration will be given to extending the response time.
