LICENSEE'S PROPOSAL FOR RESOLUTION OF REMANDED ISSUE REGARDING THE AVAILABILITY OF SCHOOL BUS DRIVERS FOR THE OWEN J. ROBERTS AND SPRING-FORD SCHOOL DISTRICTS Preliminary Statement In ALAB-836, the Atomic Safety and Licensing Appeal Board (" Appeal Board") affirmed the Third Partial Initial Decision issued by the presiding Atomic Safety and Licensing Board (" Licensing Board" or " Board") in all respects except two. The single matter remanded for further disposition is the assurance of drivers for the school buses needed to evacuate the school children of the Owen J. Roberts and Spring-Ford School Districts in the event of an accident at the Limerick Generating Station (" Limerick").1

L In accordance with the remand instruction of ALAB-836, the Licensing Board issued an Order, dated - May 22, 1986, which directed Licensee to submit its proposal for resolu-tion of the remanded issue within 20 days of the service date (May 27) of the order.

Licensee's Proposal For Resolution Of The Remanded Issue As set forth in the attached affidavit of Vincent S.

Boyer, Senior Vice-President, Nuclear Power, Philadelphia Electric Company, the Licensee, has continued to cooperate with the appropriate Commonwealth, County and local of fi-cials in the further development of the emergency plans which involve the Limerick Generating Station. Its efforts included identifying company personnel who might be willing to volunteer in their communities to assist in various aspects of emergency planning. (See the attached letter (Footnote Continued) control was left to the discretion of the responsible officials. As a matter of information for the Licensing Board, following the completion of the evidentiary hearings in this case one and one-half years ago, Chester County revised its plan to include, inter alia, the stationing of three Pennsylvania State Police officers at the intersection of Route 100 and the Pennsylvani.a Turnpike. (Chester County Plan, Annex F, App. 5 at p.150). As a matter of further information, we are informed that the Commonwealth is now reconstructing the Downingtown Interchange, as part of its overall program, so that - southbound traffic entering the Turnpike will pass under Route 100, thus eliminating any delay to southbound traffic. (Like Dr.

Urbanik, the Appeal Board presumably was unaware that there is a single access point to the Turnpike at Downingtown whether the traffic is eastbound or westbound.)

The Company maintains a list of employees who are licensed drivers. At a meeting on June 5, 1986 with Mr.

Campbell, the Chester County coordinator, and Mr. A.

Lindley Bigelow, Montgomery County Coordinator, it -was determined that the immediate solution for the Appeal Board's findings as to driver availability in the Owen J.

Roberts and Spring-Ford School Districts was to obtain a reserve of qualified volunteer bus drivers in each county.

Company representatives also met with Pennsylvania Emergency Management Agency on June 6, 1986, at which time the problem and the Counties' views were discussed.

In the event an emergency developed requiring possible evacuation and it were determined that a sufficient number of regular bus drivers might not be available, the volun-teers would be immediately mobilized. For Chester County, these drivers would report to the Chester County marshalling l center at Exton and thence be transported to the various schools in the Owen J. Roberts school district to drive the 4

buses. For Montgomery County, the drivers would assemble at the Company's Berwyn Transportation Center for similar I

transportation to the Spring-Ford Schools in Montgomery County. See the attached affidavits of Messrs. Bigelow and Campbell.

Two hundred seventy company individuals who can reach Berwyn within 30-90 minutes of notification, and 300 who

could reach Exton within 30-90 minutes have now volunteered to serve as school bus drivers in the event of an emergency requiring evacuation. The estimates show that for Berwyn 105 could arrive within 30 minutes, 40 within 60 minutes, and 125 within 90 minutes. For Exton, 95 could arrive within 30 minutes, 25 within 60 minutes, and 180 within 90 minutes. Specifically, each volunteer has agreed:

a. To drive a school bus as may be necessary upon request by the Chester or Montgomery County Coordinator.
b. To take training to qualify for a Commonwealth of Pennsylvania Class 4 driver's license, which authorizes operation of school buses and to maintain it.

Conclusion Following the format established by the Appeal Board in the previous remand in this proceeding, we have attached a proposed stipulation by the parties to this proceeding, recognizing the steps taken by the Licensee to address the Appeal Board's findings. In the event this Stipulation is agreeable to the parties, it would be a basis for the Licensing Board to enter an order dismissing the remanded proceeding.

In the event the parties do not agree to stipulate dismissal based on the provisions for the supply of volun- -

teer reserve drivers, it is requested that this response, together with the accompanying affidavits, be treated as a motion for summary disposition.

For- the reasons discussed above, the Licensee has assured that more than an adequate number of reserve school bus drivers will be available (1) in the event an evacuation were necessary and (2) in the event that a sufficient number of regular bus drivers were not available. On this basis, the proceeding should be dismissed.

As you will remember our discussion revolved around the fact that these would have to be persons who would volunteer for all natural disasters and not just those connected with the radio-logical emergency at Limerick. -

After reviewing not only our perso'nnel needs for incidents at the Limerick Generating Station but also for incidents at the Peach Bottom Atomic Power Station and for emergencies in, general in Chester county, I would like to explore this offer a little more with you or your representatives. If the people who have volunteered for duties I with municipal emergency management agencies in the Limerick EPZ are an uample of the electric companies personnel that would step forward to a Countywide appeal, this is a resource that must not be neglected.

not only with the Malvern Fire Company but also with th'e amateur radio

! emergency service, and Norman Mould, active with our four-wheel drive l club. These types of individuals are the ones that get things done and would be of benefit to Chester County's emergency response programs.

, I , realize that during a weather emergency many utility company personnel have assignments connected with the restoration of power to your service area. However, in many other emergencies, your services ..

. are not affected and I would expect that many of your people would be available for service. As I tr.entioned earlier, we would be looking for

personnel willing to voluntear for all emergencies not just those affecting the two nuclear power plants or the electric company's operation. ,

Generally, we would be looking for people with specialised skills such as amateur radio operators, heavy equipment operators, mechanics,.

millwrights, as well as those persons involved in general administration.

One desirable group would be those persons who have had experience with or are presently servi.ng with fire m eios, ambulance services and rescue squads. This group of individuals is already acoustomed to the +

self-discipline required for volunteer emergency services and can be '

relied on in times of danger and threats to the public safety.

To my intention, if people step forward, to enroll these persons as emergency management volunteers of the County of Chester not only to fulfill needs in support areas such.as resource receiving, transportation staging, also to fulfill such mundane tasks as filling and piling sandbags should that ever. occur in Chester County. In all, I think the offer by Philadelphia Electric Company to utilize its inhouse systems to solicit people in such community service is laudible and I appreciate your offer.
