Pursuant to the Atomic Energy Act of 1954, as amended, the Energy Reorganization Act of 1974 (Public Law 93-438), and Title 10. Code

SUBJECT: LICENSE AMENDMENT
Please find enclosed License No. 50-29001-01. You should review this license carefully and be
sure that you understand all conditions,
in a letter dated March 10,1999, Mr. John Pearce requested information about the
decommissioning of radioactive materials and termination of materials licenses. We have
enclosed copies of draft Regulatory Guide DG-4006, entitled " Demonstrating Compliance with
-
the Radiological Criteria for License Termination;" Appendix B from theMulti-Agency Radiation
Survey and Site Investigation Manual (MARSSIM) that outlines a simplified procedure for
completing a final status survey; and the supporting documents referenced in Appendix B. The
complete MARSSIM manual can be found on the Internet at NRC. gov under Nuclear Materials
and Radioactive Waste. NRC Administrative Letter 96-05, Revision 1 dated July 14,1998,
copy enclosed, informs licensees of their responsibility to comply with the requirements of the
Rule, " Timeliness in Decommissioning of Material Facilities (59 FR 36026-36040, July 15,
1994). These references should provide the appropriate guidance for decommissioning your
facility. If you have any questions, you may contact me at (817)860-8143.

NRC expects licensees to conduct their programs with meticulous attention to detail and a high
standard of compliance. Because of the serious consequences to employees and the public
which can result from failure to comply with NRC requirements, you must conduct your program
involving radioactive materials in accordance with the conditions of your NRC license,
representations made in your license application, and NRC regulations. In particular, note that
you must:
1.
Operate in accordance with NRC regulations 10 CFR Part 19, " Notices, instructions and
Reports to Workers: Inspection and Investigations," 10 CFR Part 20, " Standards for .
Protection Against Radiation," and other applicable regulations.
2.
Possess radioactive material only in the quantity and form indicated in your license.

3.
Use radioactive material only for the purpose (s) indicated in your license.

4.
Notify NRC in writing of any change in mailing address (no fee required if the location of
radioactive material remains the same).

5.
Request and obtain written NRC consent before transferring your license or any right

thereunder, either voluntarily or involunMrily, directly or indirectly, through transfer of

contu.4 of your license to any person or entity. A transfer of control of your license

In addition, appropriate license amendments must be requested and obtained for any
other planned changes in your facility or program that are contrary to your license or
contrary to representations made in your license application, as well as supplemental
correspondence thereto, which are incorporated into your license. A license fee may be
charged for the amendments if you are not in a fee-exempt category.
6.
Maintain in a single document decommissioning records that have been certified for
completeness and accuracy listing all the following items applicable to the license:
Onsite areas designated or formerly designated as restricted areas as defined in
10 CFR 20.3(a)(14) or 20.1003.
Onsite areas, other than restricted areas, where radioactive materials in
quantities greater than amounts listed in Appendix C to 10 CFR 20.1001-20.2401
have been used, possessed, or stored.
Onsite areas, other than restricted areas, where spills or other unusual
occurrences involving the spread of contamination in and around the facility,
equipment, or site have occurred that required reporting pursuant to 10 CFR 30.50(b)(1) or (b)(4), including areas where subsequent cleanup procedures
have removed the contamination.
Specific locations and radionuclide contents of previous and current burial areas
within the site, excluding radioactive material with half-lives of 10 days or less,
depleted uranium used only for shielding or as penetrators in unused munitions,
or sealed sources authorized for use at temporary job sites.

Location and description of all contaminated equipment involved in licensed
operations that is to remain onsite after license termination.
7.
Submit a complete renewal application, or termination request at least 30 days before
the expiration date on your license. You will receive a reminder notice approximately
90 days before the expiration date. Possession of radioactive material after your license
axpires is a violation of NRC regulations.
8.
Request termination of your license if you plan to permanently discontinue activities
involving radioactive material.
You will be periodically inspected by NRC. Failure to conduct your program in accordance with
NRC regulations, license conditions, and representations made in your license application and
supplemental correspondence with NRC wili result in enforcement action against you. This
could include issuance of a notice of violation; imposition of a civil penalty; or an order
suspending, modifying, or revoking your license as specified in the " General Statement of
Policy and Procedure for NRC Enforcement Actionc" (Enforcement Policy), NUREG 1600,
Rev.1.

Dear Dr. Campell,
As I mentioned during our phone conversation today, I wish to make amendments to
our current Materials License (# 50-29001-01).
The first amendment concerns transferring my duties as Radiation Safety Officer
j
as I will be leaving the Alaska Biological Science Center to take a new position
'
elsewhere. I wish to transfer my duties as Radiation Safety Officer for the Center's
Molecular Ecology Laboratory (MEL) to Barbara Pierson effective 15 April 1999.
Ms. Pierson, a Geneticist at the MEL, is currently listed on our license as a non-
supervised user. Ms. Pierson has a B.S. in Animal Sciences from the University of
!
lilinois and has v. eed with the Molecular Ecology Laboratory for the past 2 and-a-half
years. During this time, she has obtained extensive training and experience in the
'
proper use, monitoring, and storage of the radioactive isotopes we currently have in our
laboratory. Training at the MEL involved instruction and monitoring by the Radiation
Safety Officer and an annual course in safety issues regarding radioactive materials. I
strongly reccamend Ms. Pierson as a qualified and meticulous employee. She is very
capable of con inuing the monitoring, record keeping, and safe use policies associated
,
with the Radiat on Safety Officer position.
The second amendment to our license is the removal of myself and Kim Scribner
from the license. Dr. Scribner left the MEL in October of 1997 to accept a position
elsewhere.
Finally, the MEL seeks information about the decommissioning of radioactive
materials and termination of our materials license. We are currently in the process of
phasing out our use of a SS, a 2P, and y 2P isotopes in exchange for a
nonradioactive genotype detection system. Our current materials license was renewed
in November of 1998 and expires 31 October,2004. We anticipate using a-32P and y-

32P isotopes during the next few months, but feel that use will cease activity with these
isotopes by November of 1999. However, at that time we will still be storing materials,
particularly a SS, that will not have reached below background levels of radiation.
Our bureau Radiation Safety Officer informed me that there are several forms
(e.g., Timeliness Rule for Decommissioning, NUREG/CR-5849, NUREG/BR-0241, and
NRC form 314) and final procedures we must follow for decommissioning. I would be
grateful if you could forward these documents and other appropriate information to me.
Also, could you send information regarding licensing after we cease to use, but
{
continue to store decaying isotopes mentioned above.
