SUBJECT: NRC INSPECTION REPORT 50-361/98-18; 50-362/98-18 AND NOTICE OF

VIOLATION

Dear Mr. Ray:

From November 9 through December 18,1998, a special inspection of the circumstances

surrounding the inadvertent inoperability of the Units 2 and 3 Train B emergency chilled water

system during August and September 1998 was conducted at your San Onofre Nuclear

' Generating Station, Units 2 and 3, reactor facility. The enclosed report presents the scope and

results of that inspection.

Based on the results of this inspection, the NRC has determined that a violation of NRC

requirements occurred. The violation is cited in the enclosed Notice of Violation (Notice) and

the circumstances surrounding it are described in detail in the enclosed inspection report. This

violation was of concem because operators ran the chiller lube oil pump with the compressor in

standby for a period longer than recommended, which resulted in a degraded chiller.

The NRC has concluded that information regarding the reason for the violation and the

corrective actions taken and planned to correct the violation and prevent recurrence is already

adequately addressed on the docket in the enclosed inspection report. Therefore, you are not

required to respond to this letter unless the description therein does not accurately reflect your

corrective actions or your position. In that case, or if you choose to provide additional

information, you should follow the instructions specified in the enclosed Notice.

In addition, one apparent violation (EA 98-563) was identified and is being considered for

escalated enforcement action in accordance with the " General Statement of Policy and

.

Procedure for NRC Enforcement Actions" (Enforcement Policy), NUREG-1600, Revision 1.

The apparent violation involved the inoperability of the Train B emergency chilled water system

in excess of the action times required by Technical Specification Limiting Condition for

Operation 3.7.10. The NRC reviewed your risk determination and recognized that it was

comprehensive, which war., a strength. However, the NRC interpreted the results of the risk

analysis differently and determined that the apparent violation was potentially risk significant.

need for lasting and effective corrective action were discussed with members of your staff at the

inspection exit meeting on December 18,1998. Because the criteria for granting identification

,

and corrective action credit were met, the NRC determined that it may not be necessary to

conduct a predecisional enforcement conference to enable the NRC to make an enforcement

decision.

Before the NRC makes its enforcement decision, we are providing you an opportunity to either

(1) respond to the apparent violation addressed in this inspection report within 30 days of the

date of this letter or (2) request a predecisional enforcement conference. if a conference is

'

held, it will be open for public observation. The NRC will also issue a press release to

announce the conference. Please contact Linda Smith at (817) 860-8137 within 7 days of the

date of this letter to notify the NRC of your intended response.

If you elect to respond to the apparent violation, your response should be clearly marked as a

Response to An Apparent Violation in Inspection Report No. 50-361; 362/98-18 and should

include: (1) the reason for the apparent violation or, if contested, the basis for disputing the

apparent violation, (2) the corrective steps that have been taken and the results achieved,

(3) the corrective steps that will be taken to avoid further violations, and (4) the date when full

compliance will be achieved. Your response should be submitted under oath or affirmation and

may reference or include previous docketed correspondence, if the correspondence adequately

addresses the required response. If an adequate response is not received within the time

specified or an extension of time has not been granted by the NRC, the NRC will proceed with

its enforcement decision or schedule a predecisional enforcement conference.

In addition, please be advised that the number and characterization of the apparent violation

described in the enclosed inspection report may change as a result of further NRC review. You

will be advised by separate correspondence of the results of our deliberations on this matter.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its

enclosures, and your response (if you choose to provide one) will be placed in the NRC Public

Document Room (PDR). To the extent possible, your response should not include any personal

privacy, proprietary, or safeguards information so that it can be placed in the PDR without

redaction.
