NOTICE OF VIOLATION Battelle Colornbus Laboratories License No. SNM-7 As a result of the inspection conducted on May 12-16, 1986, and in accordance with " General Statement of Policy and Procedure for NRC Enforcement Attions,"
10 CFR Part 2,_ Appendix C (1985), the following violation was identified:,
49CFR173.441(b)(1)requiresthate'achpackageofradioactivematerialsoffered for transportation as an exclusive use shipment on an open transport vehicle shall be designed and prepared for shipment so that under conditions normally incident to transportation the radiation level does not exceed 200 millirem per hour at any point on the accessible external surface of the package.
Contrary to. the above, on Decerber 10, 1985, a cask containing reactor activated waste shipped from Battelle Columbus Laboratories to Chem-Nuclear at Barnwell, South Carolina as an exclusive use shipment on an open transport vehicle was discovered to have an external surface reading of 300 millirem per hour.
This is a Severity Ledel II1' violation (Supplement V).
The in'spection showed that action had been taken to correct the identified violation and to prevent recurrence.
Consequently, no reply to the violation is required and we have no further questions regarding this matter.
