Purpose:
To inform thee Commission of the establishment of an inter-agency. study group to assess operational problems of the U.S.
Government in the event that terrorists threaten to employ an agent of mass destruction.
Background:
The President, in a memorandum to the Secretary of State dated September 25, 1972, entitled " Action to Combat Terrorism," established a Cabinet Comittee to Combat Terrorism, chaired by the Secretary of State, comprised of representatives of various agencies. This Committee is supported by a Working Group comprised of senior members of the Committee, chaired by the designee of the Secretary of State.
NRC officially designated Mr. R. G, Page as its representative on the Ccmmittee via a letter from Mr. L. V. Gossick to Mr. John N. Gatch, Department of State, on April 24, 1975.
The present members of the Wr-king Group are depicted in Enclosure 1.

Mr. R. G. Page Acting Director, Division of Safeguards the Chairman of the Working Group, Mr. Robert A. Fearey, Department of State, proposed that an interagency study group be established to conduct a " Nuclear Terrorism Crisis Manage-ment Study." In summary, the study would assess the operational problems that the U.S. Government can anticipate in the event terrorists should threaten to employ an agent of mass destruction (nuclear chemical or biological). The study group would be composed of representatives from the Department of State (ACDA), the Department of Defense, the Department of Justice, the National Security Council, the Office of Preparedness (GSA)
ERDA, and NRC.
The study group would be chaired by Dr. Robert Kupperman, of the Arms Control and Dis-armament Agtncy (ACDA).

The Commissioners Several coments were made concerning the proposed study as follows:
(1) The ERDA and Department of Justice representatives questioned whether ACDA should chair the study group.
The ERDA representative made no recomendation as to which agency should chair the study group; the Justice representative suggested that the Department of Justice chair it. The Chairman of the Working Grcup/ Cabinet Comittee to Combat Terrorism indicated that he had selected Dr. Kupperman because of his expertise and not because of his agency affiliation.

Inasmuch as the proposed study will consider terrorism threats from nuclear, chemical and biological agents, several persons suggested that the title of the proposed study be changed to " Mass Destruction Terrorism Crisis Management Study." The Chairman of the Working Group in-dicated agreement with making a name change.
(3) Two persons suggested that there was insufficient time to complete the study by mid-July 1975. Additional time was suggested. The Chairman of the Working Group replied that he thought the study group could complete a preliminary assessment of the problem by then.
(4) Mr. Page expressed his belief that a study such as this is vitally needed.
On June 2, 1975. Dr. Kupperman convened the first meeting of the study group attended by Mr. R. G. Page and Mr. T. F'.-Carter, of the Division of Safeguards. Little was accomplished other than adoption of a revised " Terms of Reference" for the study, N*.
It was agreed to meet again on June 16 and thereafter approximately every ten days.
It is felt that participation in this study affords NRC an opportunity to influence the definition of U.S. Government pro-cedures and guidelines to be implemented in response to terrorist threats to employ nuclear weapons or contan'inants.
NRC representatives will focus, among other things, on legislative authority for contingency planning, technical team composition necessary to assess the threat validity, and a continual

assessment of the impact upon the NRC's regulatory mission of the study group's proposed recomendations.

Secretary Kissinger, in his May 12 speech in St. Louis, warned that "as nucicar weapons nroliferate, nuclear catas-tropheloomsmoreplausible--wbotherthroughdesignor miscalculation, accident, theft, or blackmail."
His statement is a reficction of the increasing attention which has been paid over the past several years, including by a number of Congressional committees to the potential for terrorist threats involving weapons, capabic of inflicting mass fatali-ties, particularly the threat of nuclear terrorism but also that of chemical and biological agents.
Thus far the focus of Executive Branch efforts to combat this
- cat has been upon nuc] car weapons and materials physical security and accounting measures.
Relatively littic attention has been paid to the question of what the USG should do in the.
event those measures are unsuccessful and nucicar (or other mass fatality) weapons are stolen by terrorists or terrorists are abic to assemble such weapons.
Carefully developed proced-urcs and gul<iclines for managing the response of the USG to terrorists threats to employ such weapons should be established.
Study Group Under the auspices of the h'orking Group of the Cabinet Com.nittee to Combat Terrorism, a study group is hereby formed to prepare a preliminary assessment of the operational problems the USG can anticipate in the event of terrorists plausibly threatening to employ an agent of mass destruction, and to make recommendations for substantive governmental actions.
The study group will be composed of representatives of the Department of State (ACDA), the Department of Defense (ISA),

the FBI, the NSC Staff, the Office of preparedness (CSA), the Energy Research and Development Administration (ERDA), and the Nuclear Regulatory Commission.
The study group will be, chaired by the representative of the U.S. Arms Control and Disarmament Agcacy.
Study Agenda The study group will:
