ACTION: Final rule,.

SUMMARY

The Nuclear Regulatory Commission is revising it.s statement of organization and generalinformation to reflect the reorganization within the Office of Administration, the creation of the Office of the Chief Information Officer and the creation of the Office of the Chief Financial Officer, These changes are necessary to inform the public of these administrative changes to the NRC's regulations.

SUPPLEMENTARY INFORMATION:

On April 21,1997, the NRC announced the reorganization of the Office of Administration effective April 15,1997. The purposes of the reorganization were to (1) further emphasize the Office's service philosophy by centralizing employee services in a new Division of Administrative Services encompassing an Administrative Services Center, (2) gain efficiencies by integrating the functions of security and facilities management in a single organizational unit; (3) streamline ADM's structure by improving the supervisor / employee ratio; and, (4) accomplish

, other operational efficiencies.

This final rule also notifies the public that the Office of information Resources

' Management and the Office of the Controller have been abolished and that the functions of L

- these offices have been incorporated into the newly created Office of the Chief Information

Officer and the Office of the Chief Financial Officer respectively.

This final rule also notes the name change of the Office of Personnel to the Office of Human Resources and other minor administrative changes.

Because these amendments deal with agency practice and procedures, the notice and comment provisions of the Administrative Procedure Act do not apply pursuant to 5 U.S.C.

553(b)(A). The amendments are effective upon publication in the Federal Register. Good cause exists to dispense with the usual 30-day delay in the effective date because these amendments are of a minor and administrative nature, dealing with the agency's reorganization.

EnvironmentalImpact: Categorical Exclusion The NRC has determined that this final rule is the type of action described in categorical exclusion 10 CFR 51.22 (c) (2). Therefore, neither an environmental impact statement nor an environmental assessment has been prepared for this final rule.

4 Paperwork Reduction Act Statement This final rule contains no information collection requirements and, therefore, is not subject to the requirements of the Paperwork Reduction Act of 1980 (44 U.S.C. 3501 et seq.).

The Chairman is the principal executive officer of and the official spokesman for the NRC, as mandated by the Reorganization Plan No. I of 1980. As principal executive officer, the Chairman is responsible for conducting the administrative, organizational, long-range planning, budgetary, and certain personnel functions of the agency. He/she has ultimate authority for all NRC functions pertaining to an emergency involving an NRC license. His/her actions are governed by the general policies of the Commission.

Safeguards responsibilities include development of overall l

agency policy, monitoring and assessment of the threat to the environment including liaison with intelligence agencies as appropriate, and those licensing and review activities appropriate to deter and protect against threats of radiological sabotage and thieats of theft or diversion of special nuclear material at fuel facilities and during transport. Identifies and takes action to control safety and safeguards issues for activities under its responsibility, including consulting and coordinating with international, federal, state, and local agencies, as appropriate.

Maintains liaison with other government agencies and trade associations. Coordinates efforts with appropriate NRC offices. Develops and recommends for approval by the Executive Director for Operations the overall NRC policy providing for equal employment opportunity in all aspects of federal personnel practice. Develops, monitors, and evaluates the Affirmative Employment Program plan to assure compliance with NRC policy. Serves as contact with local and national public and private organizations to facilitate the NRC Equal Employment Opportunity Program.
