An application for an amendment to the Davis-Besse Nuclear Power Station (DBNPS), Unit Number 1 Operating License NPF-3, Appendix A, Technical Specifications (TS) to change TS 3/4.4.3, Safety Valves and Pilot Operated Relief Valve - Operating, and associated TS Bases 3/4.4.2 and 3/4.4.3 was submitted by Toledo Edison (TE) to the Nuclest Regulatory Commission (NRC) on September 29,1995 (TU Serial Number 2325). On August 5,1996, supplemental information (TE Serial Number 2396) in support of the amendmerit application was submitted to the NRC to resolve questions with regard to the acceptability of a minus three percent tolerance for as found Pressurizer Code Safety Valve (PCSV) setpoints in relationship to the Pilot Operated Relief Valve (PORV) setpoint. On July 29,1997, additional supplemental information (TE Serial Number 2478)in support of the amendment application was submitted a the NRC to include a change to the Limiting Safety System Setting TS Bases page B 2 6 for " Reactor Coolant Pressure - Low, liigh, and Pressure Temperature."
The current TS Bases page B 2-6, as amended via License Amendment No.189, includes a statement as follows:

- Page 2 The July 29,1997 letter proposed to change the noted " set pressure" in this TS Bases section from "5 2525 psig" to "s 2575 psig" consistent with the change in set pressure tolerance of 1%
to 3% proposed in the September 29,1995 License Amendment application, llowever, based on further review, TE has now identified that the current TS Bases (License Amendment No.189) discussion of the set pressure of 5 2525 psig, as explained in the following, should not have included any set pressure tolerance.
The set pressure of 5 2525 psig in the current TS Bases renects the " nominal" set pressure of 5 2500 psig plus 14 for tolerance, llowever, the TS Bases statement is discussing the fact that the RC high pressure trip setpoint (2355 psig)is set lower than the PCSV set pressure. Therefore, referring to a value of s 2525 ps;g for the PCSV set pressure is inappropriate in this TS Bases when discussing the available margin between the RC high pressure trip setpoint and the PCSV set pressure.
It is appropriate that TE revise these TS Bases to refer to the " nominal" set pressure of 5 2500 psig, or alternatively, to refer to Liniiting Condition for Operation (LCO) 3.4.3 in place of providing an actual set pressure value. Ilowever, this revision is not associate., with or necessary for the License Amendment requested by TE's September 29,1997 application. By April 30, 1998,TE will submit a follow up License Amendment application, independent of the September 29,1995 application, to revise the referenced set pressure of s 2525 psig in TS Bases page B 2-6.
Based on the above, TE hereby withdraws the July 29,1997 letter. The withdrawal of this letter has no effect on TE's September 29,1995 License Amendment application. Toledo Edison requests the NRC's approval of the September 29,1995 License Amendment application by January 30,1998.
