AFFIDAVIT OF RICHARD H. STROME (NECNP CONTENTION RERP-2)

I, RICHARD H. STROME, being on oath, depose and say as fcllows:

1. I am the Director of the New Hampshire Civil Defense Agency (NHCDA).

2. As set forth in Section 1.4 of the New Hampshire Radiological Emergency Response Plan (NHRERP), there are only three areas in which the State of New Hampshire may require federal assistance in carrying out emergency measures under the NHRERP.

These are regulation of boating activities (U.S. Coast Guard);

restriction of overflights of the Plume Exposure EPZ (FAA);

shellfish contamination screening.

3. The availability and willingness of the Coast Guard to regulate boating activities is set forth in a letter of agreement dated February 24, 1986, and contained in Volume 5 of the NHRERP.

The U.S. Coast Guard resources are readily available. The broadcast to mariners requires no travel. It can be implemented by telephone. Travel for U.S. Coast Guard personnel from Boston to the IFO at Newington Station should take approximately one hour. This travel time could be reduced should the Coast Guard elect to travel by helicopter (if one is available at the time)'. Travel times for vessels and ' crews to be used depend upon availability of vessels and crews at Merrimac Station, Gloucester Station and Portsmouth Station, and upon marine conditions at the time. The State estimates that the first responders could be available offshore of the EPZ within an hour of notification and that several vessels could be available, if necessary, within two to three hours.

4. The availability of FAA to control overflights is documented in a May 14, 1986 tietter from FAA, a copy of which is attached hereto and marked "A", and which will be incorporated in Volume 5 of the NHRERP. FAA will require no " travel time" to be in position to act.

5. The shellfish contamination screening may be requested of the federal government if such assistance cannot be provided under the terms of the New England Interstate Radiation Assistance Plan.

Whether provided by EPA labs in the Boston area or by some other Federal Agency under the FRERP such as FDA, this activity is not time sensitive. Shellfish areas may simply be closed for harvesting until samples are sent to the appropriate laboratory, and results and analysis returned. Thus " arrival" time is not crucial to the State's emergency response.

g 6. Based upon the foregoing it is my opinion that there exists reasonable assurance that required federal assistance will be available in a timely matter.

Dear Mr. Strome:

In reference to our conversation on this date to restrict airspace around Seabrook Station Nuclear Power Plant (42* 53' 54.15"N/70* 50' 58.77"W),if a Nucicar Incident should occur the following procedures are to be followed:

.1. The New Hampshire Civil Defense Agency will call the Concord FSS (Tel. 224-7474, 800-852-3427, FTS 834-4505) and advise that a Nuclear Incident at Seabrook Station has taken place and reouest@6g6 that the Concord FSS take NOTAM ACTION.

3 2, The Concord FSS will send the following NOTAM: MIT10002g S BROOK HUCLEAR POWER PLANT. AIRBORNE HAZARD T0XIC OR RADIO ACTIVE EMISSIONS.

AVOID FLT WI SNHR 60MSL AND BLO. COORDINATION FAC PSM APCH.

Note: 60 equals 6000.

3. The Concord FSS will pass this Notam to Pease Approach Control, the Watch Supervisor and the Traffic Management Unit at the Boston Center. The notam will also be transmitted on Service "B".

4, The NH Civil Defense Agency is responsible for notifing the' Concord FSS for Cancellation.

Note: If the Concord FSS Specialist.has any doubt that the person calling is from the NH Civil Defense they will call back on Tel. 271-2231 for verification.
