Dear Sir or Madam In Reference 1, the U S Nuclear Regulatory Comm1ss1on (NRC) issued Order EA-02-026, "Order for Interim Safeguards and Security Compensatory Measures - for Indian Point Nuclear Generating Stations, Unit Nos 2 & 3" to Entergy Nuclear Operations, Inc (Entergy)
In Reference 2, Entergy notified the NRC that 1t has decided to permanently cease operations at Indian Point Nuclear Generating, Units 2 and 3 (IP2 and IP3) no later than April 30, 2020 and April 30, 2021 for IP2 and IP3 respectively Once cert1ficat1ons for permanent cessation of operations and permanent removal of fuel from each reactor vessel are submitted to the NRC 1n accordance with Title 10 Code of Federal Regulations (CFR) 50 82(a)(1)(1) and (11) per 10 CFR NOTICE The enclosure of this letter contains "Safeguards Information " Upon separation of the enclosure from this letter this page becomes "DECONTROLLED " _s D D \

SAFEGUARDS INFORMATION NL-19-047 Page 2 of 2 50 82(a)(2), the 10 CFR Part 50 license no longer will permit operation of the reactor or placement of fuel in the reactor vessel Pursuant to Section Ill D of Order EA-02-026, a request to rescind Interim Compensatory Measure (ICM) 8 1 a 1s provided in the enclosure to this letter This resc1ss1on request 1s part of the trans1t1on from an operating station to a non-operating station The enclosure to this letter provides the basis for resc1ss1on of the subject security order and contains Safeguards Information as defined by 10 CFR 73 21 and its disclosure to unauthorized ind1v1duals 1s proh1b1ted by Section 147 of the Atomic Energy Act of 1954, as amended Entergy requests resc1ss1on of the Order by June 30, 2020 and that the resc1ss1ons become effective 1mmed1ately for Unit 2 (the unit 2 10 CFR 50 82(a)(1)((1) and (11) submittal will be made in May 2020) and following submittal of the cert1ficat1on required by 10 CFR 50 82(a)(1)((1) and (11) for IP3 (approximately May 2021)
