ENVIRONMENTAL ASSESSMENT FOR THE FULL TERM OPERATING LICENSE (TAC NO. 52336)

Re: Oyster Creek Nuclear Generating Station The NRC staff has performed an assessment of the Final Environmental-Statement (FES) dated December 1974.

In a letter dated November 5, 1982, you were requested to review the existing FES to determine what updating of information is necessary as part of the preparation for' conversion of the Provisional Operating License for Oyster Creek Nuclear Generating Station (Oyster Creek) to a Full Term Operating License (FTOL). You responded to this request by letters dated December 21, 1982, March 21, 1983; and April 2, 1984, which presented your detailed review of the FES upon which you stated that your review did not find any significant changes that would adversely affect the conclusions in the FES.

The NRC staff has evaluated the effects of continued operation of the Oyster Creek facility and reexamined the impacts initially presented in the FES and your submittals. This review, which is documented in the enclosed Environmental Assessment, has not led to the identification of any significant new environmental impacts or changes from those identified previously in the FES with respect to the proposed FTOL for Oyster Creek.

The NRC staff has determined, based on the additional information you have provided, that (1) there are no new impacts that differ significantly from those evaluated in the FES, there are no substantial changes in the proposed actions relevant to environmental concerns and there are no significant new circumstances or information relevant to environmental concerns bearing on the proposed action or its impact and, thus, issuance of a supplement to the FES is not required under the National Environmental Policy Act (NEPA); and (2) the conclusion on page 10-10 of the FES as applied to Oyster Creek is still valid in that (a) the benefits derived from the continued operation of Oyster Creek exceed the actual or expected environmental costs of Oyster Creek and (b) the staff recommends Oyster Creek be issued a full term operating license.

You have proposed radiological effluent technical specifications (RETS) in-your letter dated October 22, E1984 to implement Appendix I to 10 CFR Part 50.

- These RETS are being reviewed as a separate action to this environmental

- assessment and>were the subject of a meeting summary dated August 22,

~ 1985. The RETS will be the subject of a separate licensing action amending your Oyster Creek Appendix A Tec;mical Specifications.

In your application dated February 3,1986, you have requested extensive revisions to the OCNGS Environmental, Appendix B, Technical Specifications.

The application stated that you maintain an Environmental Control Plan which sets forth the objectives and policies for conservation and protection of the environment. This is being reviewed also as a separate action to this environmental assessment of OCNGS.

In the meeting summary dated November 15, 1985, the staff discussed its nonradiological environmental protection plan (EPP). The EPP has the station license conform to the Clean Water Act and requires no more than that required in the National Pollution Discharge Elimination System Permit. You are requested to review the enclosed draft EPP and to consider proposing additional changes to the Appendix B Technical Specifications to have it conform to the enclosed draft EPP. These changes would be issued with the FTOL Technical Specifications.

A copy of our Environmental Assessment relating to the conversion of the Provisional Operating License to a Full-Term Operating License is also enclosed. Section 4.5 of the enclosed Environmental Assessment discusses areas denuded for plant construction.

It is recommended that you meet the State of New Jersey's requirements for control of soil erosion and re-vegetation of denuded areas.
