REQUES1 FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NO 67743)

By your application dated March 30, 1988, and General Electric Company's (GE) affidavit dated September 24, 1987, you submitted NEDC-31462P "SAFER /

CORECOOL/GESTR-LOCA LOSS-0F-COOLANT-ACCIDENT-ANALYSIS" dated August 1987, and requested that it be withheld from public discicsure pursuant to 10 CFR 2.790.

You stated that the submitted information shouid be considr.ed exempt from mandatory public disclosure for the following reasvi,;.

1.

The inforvation discloses a process, method or apparatus where prevention of its use by GE's competitors without license from GE constitutes a ccnpetitive economic advantage over other conpanies.

2.

The inforwation consists of supporting data and analyses, including test data, relative to a process, method or apparatus, the application of which provide a cerrpetitive economic advantage, e.g., by optimization or irrproved r.arketability.

3.

The inforTnation if used by a corpetitor, would recuce his expenditure of resources or inprove his corrpetitive position in the design, tranufacture, shiprent, installation, assurance of quality or licensing of a similar product.

The infornation reveals cost or price infortration, production capacities, budget levels or concercial strategies of GE, its customers or suppliers.

The information reveals aspects of past, present or future GE custorer-furded develorrent plans and programs of potential cornercial value to GE.

The information discloses patentable subject matter for which it rnay be i

desiracle to obta 4 patent protection.

and criteria of 10 CFR 2.790 and, on the basis of GE's statenents, have determired that the submitted information sought to be withheld centaibh trade secrets or proprietary ccnrrercial infernation.

Therefore, the report will be withheld from public disclosure pursuant to l

10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as an endrrent.

l Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the document.

If the need arises, we may send copies of this infonnation to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreenents for handling proprietary information.

If the basis for withholding this information from public disclosure should change in the future such that the irMn,ation could then be trade available for public inspection, you ch,Lio pronptly notify the NRC.
