INVESTIGATION OF ALLEGED IMPROPER DISCLOSURE OF AN NPC MEMORANDUM By memorandum 6.2d April 14, 1987, Comissioner Roberts requested that the Office of Inspector and Auditor (01A) initiate an investigation to determine how an internal NRC memorandum was obtained by Mr. George E. White, an employee of Middle South Services, Inc. The NRC memorandum was dated June 8, 1983, and had been identified in the files of a Louisiana Power and Light official by Office of Investigations (01), NRC employees in March 1985 during an 01 investigation. When the 01 employees found the NRC memorandum at issue, it was attached to an internal licensee memorandum marked Confidential which indicated in its text that the NRC memorandum had been obtained from sources inside the NRC.

OIA initiated an investigation into this matter, however, in consideration of Senator John Glenn's press release on April 21, 1987, indicating that he was referring the entire matter concerning the apparent leaked document to the Department of Justice (DOJ) for its review, OIA believed it was prudent to coordinate with D0J before proceeding further in its investigation.

In that regard, on April 22, 1987, Timothy J. Reardon, III, who is the principal Assistant U.S. Attorney (AUSA) for the District of Columbia and the AUSA who handled the referral from Senator Glenn, was contacted by OIA. Mr.

Reardon advised OIA that it should not proceed with its investigation of the apparent leaked menorandum. Furthemore, he indicated that the Federal Bureau of Investigation would be requested to investigate the matter.

In consideration of the foregoing infomation, I recomend that the OIA investigative action on this matter be closed by this memorandum.
