Dear Mr. Reardon:

This is to confirm our telephone conversations on April 22, 1987, regarding Senator Glenn's referral to your office of a matter involving Comissioner Thomas M. Roberts of the U.S. Nuclear Regulatory Commission (NRC). In the first conversation that day, I advised you that NRC's Office of Inspector and Auditor (0IA) had initiated an investigation at the request of Comissioner Roberts to determine how an employee of Middle South Services, Inc. obtained an internal NRC memorandum. After making some inquiry, you subsequently requested during a second telephone conversation that OIA not proceed with its investigation. At the same time, you advised me that your office would request the Federal Bureau of Investigation (FBI) to expeditiously conduct an investigation of the matter referred to you by Senator Glenn. Furthermore, you indicated that the FBI may coordinate with OIA in conducting its investigation. You also advised me that I could infonn Comissioner Roberts of these developments.

With regard to the investigative matter at issue, enclosed is a copy of a memorandum received by OIA on April 22, 1987, and other documents related to a .

Freedom of Information Act requ st mentioned in the memorandum. The memorandum contains information which appears to be relevant to the matter -

involving Comissioner Roberts which ycur office intends to inve>tigate. The memorandum addresses possible false testimony by a senior-level NRC employee ~~

during a hearing conducted by Senator Glenn on April 9, 1987. I referred this allegation to the FBI by letter dated April 24, 1987. A copy of the April 24 letter and its enclosures are also provided herewith.

As we discussed. OIA received other allegations concerning possible false testimony by another NRC employee during the same hearing on April 9. These allegations were referred to the FBI by letter dated April 15, 1987. In accordance with your request, I am enclosing a copy of the April 15 letter and copies of other documents forwarded to the FBI with that letter.
