Notification of Changes in Regulatory Comn.hments - Compliance Plan Issue 36 - Updated Seismic Ilazard Analysis (TAC No. L32054)
Dear Dr. Paperiello:
The purpose of this letter is to notify the Nuclear Regulatory Commission (NRC) of a change in the completion date for two regulatory commitments. These commitments were made in USEC letter GDP 98-0125 dated June 18,1998 (Reference 1), and are related to the updated seismic hazard I
analysis performed in accordance with Issue 36 of DOE /ORO-2026, " Plan for Achieving Compliance with NRC Regulations at the Paducah Gaseous Diffusion Plant"(the Compliance Plan).
The specifics of the commitment changes are provided below.
Background
i in a letter dated May 13,1998 (Reference 2), the NRC requested additional information to complete its review of the updated seismic hazard analysis performed by Risk Engineering, Incorporated (REI) that was originally submitted to the NRC on December 1,1997, and revised on March 6,1998. In letter GDP 98-0125, USr C committed to provide responses to the NRC's questions and to correct the analysis documentation for the deficiencies identified by the NRC, PGDP Engineering and PGDP Safety, Safeguards and Quality personnel by August 28,1998. USEC's efforts to complete these activities were discussed in an August 20,1998, telephone conversation between Mr. Stephen Routh (USEC) and Ms. Merri Horn (NRC).
In letter GDP 98-0125, USEC also committed to perfomt a review of current policies, practices and i
procedures related to the control of subcontractors and to identify any necessary changes by August 28,1998.

Description'of Revised Commitments The above two commitments have been revised to read as follows:
" Based on resolving all identified deficiencies in the analysis documentation, USEC's responses to the NRC's May 13, 1998 questions on the updated seismic hazard analysis will be submitted by September 18,1998."

' Justification for Revised Commitments l-l:
Regarding the first commitment, PGDP Engineering is actively working with REI to resolve the identified deficiencies in the analysis documentation. Additional time is requited, however, to ensure that all of the identified issues are resolved in the REI and REI subcontractor documentation prior to submitting the question responses and revised summary report.
Regarding the second commitment, the review of policies, practices and procedures has been completed at Paducah and improvements to several procedures have been identified. These improvements are currently being evaluated at Portsmouth. Additional time is needed to reach two-site agreement on the improvements and to assess the required resources and schedule to implement the necessary changes.
USEC recognizes the lack of timeliness of this notification and regrets any inconvenience to the NRC.
