HIGHLIGHTS OF WEEKLY INFORMATION REPORT WEEK ENDING APRIL 22, 1988 Hatch 1/2 H. G. Baker, Jr.3 SeniorExecutivtVP-GeorgiaPowerCompany(GPC), notified the Region II Administrator today that Hatch will shut down for 30 days and Hatch 2 will not start up from a trip last weekend for 30 days, while INP0's findings from the INPO March 1988 inspection are reviewed and addressed.

Relaxation of February 18s 1988 Order Issued to Minnesota Mining and Manufacturing Company (3M By letter dated April 5,1988, counsel for 3M requested an extension from April 18, 1988 to July 18, 1988, as the date for filing the show cause response to the February 18, 1988 Order. The Order was relaxed on April 13, 1988 and the request was granted. Counsel for 3M indicated that groups, both within 3M and outside the company, are investigating the cause of the release of microspheres from 3M's static eliminators. Additional time is needed to complete the J

studies and to allow 3M to determine whether to seek authorization to resume manufacturing and distributing some or all of the static eliminators to persons holding specific or general licenses issued by NRC or the Agreement States.

Tour of Contaminated Sites in Ohio A tour 'of contaminated sites in Ohio was conducted on April 19-21, 1988. NRC representatives included Lee Rouse, Chief of the Fuel Cycle Safety Branch in NMS$; Wayne Shafer, Chief of the Emergency Preparedness and Radiological Protection Branch in Region !!!; and Roland Lickus, Chief of State and Governmental Affairs for Region !!I. Robert Quillin, the Ohio Radiation Control Program Director, represented the State. Local public health officials i

j joined the tour at each site. The sites visited were the Victoreen site and j

the McGeen Chemical site near Cleveland; the Shield Alloy site in Cambridge and the Sohto site in Lima.

ALTERNATIVE CONCEPTUAL MODELS On April 11-14th, representatives of the Division of High-Level Waste Management ret with the DOE and the State of Nevada to discuss alternate conceptual models j

with emphasis on the conceptual models of the hydrological flow regime at Yucca

]

Mountain. This meeting was in direct response to the NRC's Draft Objection 1 on l

the CDSCP, The meeting focused on the model used by the USGS in preparation of I

the CDSCP and an alternative model prepared by J. Szymanski of the DOE. As a result of this meeting, the DOE agreed to a revision of the CDSCP. The most substantial revision will involve the presentation of alternative conceptual l

models, which ir. the SCP will probably be made in tabular form with headings to 1

include: current representation of understanding, uncertainty in the under-standing, significance for waste isolation, and information needs for all major j

components of the natural system.

j this data across all discipline lines and will use this information to prior-itize investigations related to site cheracteriration, i

Negotiated RulemaHng on Licensing Support System for Deep Geologic Disposal i

i of High-level Waste On April 18-19, the Licensing Support System Advisory Committee (LSSAC) met at the Conservation Foundation's office in Washington, DC. Discussion at this meeting focused on the draft proposed rule, 10 CFR Part ?, Subpart J, which

represents the NRC position based on tentative agreements previously reached by the LSSAC. The Advisory Committee is scheduled to meet for further discussion of the proposed rule May 18-19 at the Conservation Foundation's office.

SAFEGUARDS Domestic l

NRC/ DOE Comparability Rule A total of five letters of comment have been received on the proposed rule from the following: 1) A fencing manufacturer, 2) NFS, 3) B&W, 4) GA, and

5) UNC. Only three of these had substantive coments on the proposed rule which are being evaluated for incorporation into the final rule, which is due to RES in July 1988.

Meeting With EPA on Mixed Waste The LLRB staff met with EPA on April 20 to establish actions and schedules for mixed waste initiatives currently in progress. The products being developed include the following:

(1) response to public comments on the definition guidan:e; (.!)(regulatory comparison of the NRC licensing and EPA pe

3) a joint guidance on sampling and testing. The staffs have process; anti also agreed to issue a joint letter to the state regulatory agencies for inspection and enforcement advising them about the problem of mixed waste, where the responsibility for these waste reside, and who to contact within NRC and EPA when the need arises.

f OFFICE OF NUCLEAR REGULATORY RESEARCH Items of Interest Week Ending April 22, 1988 PREVENTING DAMAGE TO THE REACTOR CORES IAEA Meeting on Probabilistic Safety Criteria During the week of April 11-15, 1988, Dale M. Rasmuson from RES represented the NRC at the IAEA Technical Meeting "On the Use of Probabil n tic Safety Criteria." Representatives from 15 countries participated and presented papers about the use of probabilistic safety criteria in their respective countries. The participants prepared a draft IAEA document on the use of probabilistic criteria which will be used for guidance for developing countries in the operation of nuclear facilities.

The consensus of the delegates was that criteria are targets and not limits.

It was the consensus of the group that much work must be done to develop a consistent set of criteria and that a release criterion of one fatality should be less than 1E-6 per year. Severe core damage frequencies should be in the range of IE-4 to 1E-6 per year. When the final draft of the document has been prepared, the delegates will review it again.

It will then be submitted to the IAEA and the member states for their action.

Items of Interest Office for Analysis and Evaluation of Operational Data Week Ending April 22, 1988 CRGR The CRGR met on April 18, 19, 21, and 22 to review the Indepent. ant Plant Examination proposed generic letter package.

The CRGR recommended issuance of the generic letter without the containment assessment contractor reports. The CRGR understands further staff review is needed before issuance of the reports as a NUREG/CR. The CRGR also recomended that further NRC guidance be developed by the staff, reviewed by CRGR, and communicated by workshops with the utilities to facilitate the process.

Reactor Operations Analysis A staff member of ROAB presented an invited paper entitled, "Air Systems and Their Impact Upon Nuclear Safety," at the American Power Conference in Chicago on April 18. There was a positive audience response, including over two dozen requests for copies of the AE00 case study report (NUREG-1275 Volume 2). Most of the requesters were from architect engineering and consulting engineering firms.

Incident Responst On April 22, 1983, the IRB staff conducted a tour and briefing on the Incident Response Program for senior officials from various utilities as part of the INPO senior management training course.

On April 19, 1988, IRB staff conducted training at the Federal Radiological Emergency Plan Workshop held in Emittsburg, Maryland on the NRC's role, protective action decisionmaking strategies, and FFE lessons learned.

On Wednesday, April 20, 1988, Director, AEOD and IRB staff member and Congressional Affairs staff member met with Jim Curtis of Senator Simpson's staff to discuss theEmergencyResponseDataSystem(ERDS). The specific issue of concern was rel:ted to automatic actuation of the system and whether NRC's study was responsive to appropriation bill language. Mr. Curtis requested a further briefing at the Operations Center where he can observe a test prototype.

Mr. Curtis also plans to visit a reactor facility to see an SPDS and obtain further understanding.

On April 22, 1938, an IRB staff member conducted a tour and briefing on the Operations Center for representatives from the Illinois Department of Nuclear Safety.

Diagnostic Evaluation and Incident Investigation The NRC appraisal team began evaluating ENERCON's report on management isses at 1

Turkey Point. The team managers attended a management meeting at Turkey Lofnt in connection with the evaluation on Friday, April 22, 1988.

Technical Training Center The Training Advisory Group (TAG) met at the Technical Training Center (TTC) on 4/21-22/88. All regions, NRR, NMSS, AE0D, RES, and OP were represented at This meeting provided an opportunity to discuss TTC facility and the meeting.

program changes since the last meeting; the plan for developing qualification and technical training programs for the NRC staff; training process policy; new initiatives started since the last TAG meeting; potential policy changes in Inspection Manual Chapter 1245; and relative need for, scope of, or support for a number of potential new initiatives. There were significant discussions on the need for Headquarters inspectors to have technical qualifications very similar to those of regional inspectors and on the need to take a comprehensive look at the training currently provided for Inspection team leaders. This TAG meeting was considered to be the most productive one conducted to date.

ITEMS OF INTEREST OFFICE OF GOVERNMENTAL AND PUBLIC AFFAIRS WEEK ENDING APRIL 22, 1988 INTERNATIONAL PROGRAMS Foreign Visitors On Tuesday George Liu and Charles Peng, the Washington representatives of the Coordination Council for North American Affairs, met with the ED0 and representatives from NRR and GPA/IP to discuss the NRC-Taiwan program of nuclear safety cooperation.

On Thursday Ying-Dar Tseng and Wen-Teng Chiang, Taiwan Atomic Energy Council, accompanied by Charles Peng, Washington representative, Taiwan Coordination Council for North American Affairs, met with representatives from AEOD, NRR, OE, OGC and PA to discuss a range of licensing issues.

Meeting of the U.S. - Indonesia JSC The U.S.-Indonesia Nuclear Joint Steering Committee held its third annual meeting at the Department of State on Monday, April 18. The U.S. delegation was headed by Ted Wilkinson, OES/ State, and included representatives of the State Department (R. S. Taylor, B. Percival, and K. Fiedler), ACDA (J. P.

Colton), DOE (C. Weber and K. Rees) and NRC (H. R. Denton and D. Chaney).

Indonesia was represented by Dr. Iyos Subki, Deputy Director General for Assessment of Nuclear Science and Technology of the Indonesian National Atomic Energy Corraission (BATAN) and Mr. Sutaryo Supadi, Deputy Director General for Nuclear Industrial Research and Development, BATAN.

During the morning session, the U.S. delegates reviewed the status of completed, ongoing, and planned cooperation with Indonesia and the Indonesiuns reported on the status of their nuclear energy programs.

H. Denton briefed them in the afternoon on developments in U.S. nuclear safety philosophy and criteria. The Washington portion of the meeting concluded with the Indonesian team's visit to the Council for Energy Awareness, where they held discussions on the U.S. nuclear energy outlook.

The team traveled to Brookhaven National Laboratory on April 19 to discuss the positron emission tomography program and to observe neutron spectrometers in use.

The sited States (South Carolina, Washington, and Nevada) reported that Maine is now in compliance with the Congressional milestone of January 1,1988.

Consequently, only New Hampshire, North Dakota, Puerto Rico, and Vemont remain in noncompliance. One of the main subjects of discussion was a presentation of the NRC Agreement State Program by Donald Hussbaumer.

NRC staff from NMSS and SLITP participated in sessions devoted to Federal technical assistance, NRC guidance on both alternative disposal technologies, and financial assurances.

Other topics of interest included State and regional crogress reports, State and compact responsibilities, and site selection.

On April 20 there was a site visit to the Chem-Nuclear Systems, Inc. facility located in Barnwell, South Carolina.

Low-level radioactive waste burial and transportation operations were observed by Forum participants.

In addition, some low-level and high-level radioactive waste solidification facilities which are under construction at the nearby Savannah River Plant were observed.

Tour of Contaminated Sites in Ohio A tour of contaminated sites in Ohio was conducted on April 19-21, 1988. NRC representatives included Lee Rouse, Chief of the Fuel Cycle Safety Branch in NMSS; Wayne Shafer, Chief of the Emergency Preparedness and Radiological Protection Branch in Region III; and Roland Lickus, Chief of State and Governmental Affairs for Region III.

Robert Quillin, the Ohio Radiation Control Program Director, represented the State.

OFFICE OF ENFORCEMENT ITEMS OF INTEREST Week Ending April 22, 1988 The following Civil Penalties Paid the week of April 18, 1988.

Nebraska Public Power District (Cooper Nuclear Station) paid the proposed civil penalty in the amount of $25,000. The action was based on an inadeauate search of a contractor's vehicle that resulted in the introduction of amniunition to the protected area.

Niagara Mohawk Power Corporation (Nine hile Point Unit 1) paid the proposed civil penalty in the amount of $100,000. The action was based on operation of the plant between June 1986 and September 1987 without dispositioning certain weld flaw indications which were identified by the inservice inspections conducted during the 1986 refueling outage.

Froehling and Robertson, Inc., Richmond, Virginia paid the imposed civil penalty in the amount of $4,200. The action was based on violations including failure to (1) administer periodic or refresher training at least once annually, (2) conduct a proper retraining and testing program prior to allowing a rehired individual with previous training and experience to work, (3) conduct quarterly inspections of all operations being conducted in the Radiation Safety Officer's area of responsibility, (4) reevaluate the overall Radiological Safety Program at least once per quarter in order to ensure that all areas are sufficient for the safe and efficient control of both personnel and material, (5) use applicable shipping labels and Transportation Index when shipping radioactive packages, and (6) return film badges monthly for measurements.

On April 19, representatives of the Office of Nuclear Reactor Regulation were in the Region II Office to attend a Management Meeting.

On April 19, Georgia Power Company notified Region II that they are shutting down both Hatch units for a period of 30 days to resolve recent INP0 findings.

The Regional Administrator, senior managers from the Region and an NRR senior manager met with the the Senior Executive Vice President of Georgia Power to discuss the INP0 findings.

3.

On April 21, the Deputy Regional Administrator; the Deputy Director.

Division of Reactor Safety; and a senior manager of NRR, were at the Florida Power & Light Company's Turkey Point Nuclear Power Station to conduct an Enforcement Conference concerning errors in offsite dose assessment in emergencies resulting from inadequate meteorological instrument.

In the evening, the Deputy Regional Administrator presented operator license certificates to the newly licensed reactor operators at the Turkey Point facility.

On April 21, representatives of the Virginia Electric and Power Company were in the Region II Office to attend an Enforcement Conference with the Regional Administrator regarding problems encountered during removal of a stuck in-core probe at their Surry Nuclear Power Station.

On April 22, the Deputy Regional Administrator; the Deputy Director, Division of Reactor Safety; a senior manager of NRR; and a senior manager of AE00, were at the Florida Power & Light Company's Turkey Point Nuclear Power Station to attend the monthly management meeting.

Consistent with the directives outlined at the March 22, 1988, Commission briefing on the same subject matter, submit for Commission consideration an options paper providing alternatives for rulemaking on quality assurance requirements for medical application of radioactive isotopes.

These alternatives should include (but need not be limited to):

1) the positive elements from the previously published I

NPR, incorporating suggestions and comments received from the public, where appropriate; 2) a non-prescriptive approach.

Requirements should be performance based and should allow licensees to either develop or adopt QA programs tailored to specific clinical environments; and I

3) some combination (s) of 1) and 2), above.

As part of the options paper, the staff should outline a pilot program to be conducted during the public comment period for a performance based rule.

The results of the pilot program along with the analysis of public comments should be addressed in recommending a final rule for Commission consideration.

In light of the discussion during the meeting,'the staff should also review whether the term "misadministration" itself, as well as its definition should be revised as part of the rulemaking.

Insure that the appropriate medical and scientific commu-nities are kept currently informed of medical misadminis-tration events.
