REQUEST FOR TEMPORARY WAIVER FOR COMPLIANCE FROM TECHNICAL SPECIFICATION 3.7.5.e REGARDING THE ULTIMATE HEAT SINK - BYRON STATION UNITS 1 AND 2  ;

This letter will confirm the conclusions reached during a telephone conference l on the af ternoon of July 14, 1988 between rep esentatives of CECO (M. Turbach, et al), NRR (G. Holahan, et al) and Region III (E. Greenman, et al). The NRC representatives agreed to grant a Temporary Waiver of Compliance for the Byron Station, Unit I and Unit 2 to allow changing from Mode 3 to Mode 1 which is prohibited by the requirements of the action statement 3.7.ti.e of your Technical Specification when the Rock River water level is less than 670.6 feet. This Temporary Waiver of Compliance is in effect beginning July 14, 1988, and is effective through July 18, 1988. This Temporary Waiver of Compliance was granted in view of the critical electric energy situation l brought about by the Midwest drought and associated low levels of the Rock l River. I 1

It was further agreed that CECO would revise and submit the technical input in I support of the related Technical Specification change (lettera dated June 22, 1988 and July 14,1988) by July 18, 1988. We will advise you of our decision concerning the acceptability of your request for an Emergency Technical Specification change once the information is provided and our review is completed.

The management of CECO should note that this waiver was required only oecause a submittal dated June 22, IP08 for a Technical Specification change for the same '

relief and a follow-up letter dated July 14, 1988 requesting an Emergency Technical Specification change was deficient in that it failed to provide an adequate technical basis to allow the NRC staff to reach appropriate decisions.

S)ecifically, the letters did not include a Safety Evaluation addressing tie technical basis for the chenge nor an Environmental Assessment, both of which are needed to support the iequestad aci. ions. The NRC staff is willing to cooperate with you in circumstances as above, and acknowledges the need, on occasion, for prompt action on our part in support of Emergency Technical Specification changes. We require however, under '..ne.e circumstances, an adequate fully documented analysis upon which we can vase our decisions. Accordingly we recorrrnend that you review with your technical, plant, and licensing staffs the technical and administrative requirements that must be met in order to support the license amendments and other actions that are requested of the NRC.
