On December 31, 1986 a final rule revision to 10 CFR Parts 25 and 95 was published in the Federal Register. This final rule required, as a condition for access to classified information, that all individuals cleared by NRC execute the SF 189-A, "Classified Infor.ation Nondisclosure Agreement m

(Industrial /Comerical/Non-Government)" by December 31, i987.

The Information Security Oversight Office (IS00) has advised that a rider to the Continuing Resolution for Fiscal Year 1988 (Section 630 of Public Law 100-202) signed by the President on December 22,1987 p1Mes limitations on the implementation and enforcement of the Agreement.

1500 is seeking an Opinion of the Attorney General on the impact of this legislation on the Agreement, and will advise us of the outcome.

In the interim, and rending further instructions, do not take any further action under the provisions of 10 CFR Parts 25 and 95 which pertain specifically to the SF 189-A. You should, however, continue to follow the general security education requirements of Section 95.33, to include a security indoctrination which fully addresses the cleared individual's obligations to protect classified information. Any existing executed SF 189-A's which have already been obtained should be forwarded to the NRC Division of Security for retention, but additional use of the Agreement must cease.
