Dear Mr. Chairman:
I am responding to your February 9, 1988 lettar concerning compliance with Section 630 of P.L. 100-202. I can report that no appropriated funds for the Nuclear Regulatory Commission (NRC) have been used, subsequent to December 22, 1987, to implement or enforce the agreements in Standard Forms 189, 189-A or 4193.
Efforts by NRC to ensure compliance with Section 630 of P.L.
100-202 have been timely. On January 7, 1988, the NRC Division of Security contacted our Office of Personnel and corresponding regional components by telephone and advised them of the dis-continued use, until further notice, of Standard Form 189 (SF 189). Additionally, the language on the "Notification of Access Authorization Action" to NRC contractors and licensees was revised as of January 6, 1988 (Enclosure 1). By memorandum and letters dated February 1, 1988, the Director of Security provided a de-tailed explanation regarding the discontinued use of the SF 189 and 189-A to pertinent NRC components and affected NRC contractors / licensees (Enclosures 2-4). However, between December 22, 1987, and the receipt of NRC's detailed guidance, contractor and licensee employees completed a total of 20 SF 189-A's. Since December 22, 1987 it has not been necessary for any NRC employee to complete SF 4193. We have not processed any NRC contractors or licensees for Sensitive Compartmented Information access and, therefore, it has not been necessary to advise them of the provisions of P.L. 100-202 regarding SF 4193. ;
Additional guidance received from 1500 (Enclosure 6) and guidance from the Central Intelligence Agency (Enclosures 7-8) pertaining to this law are provided in accordance with your request.
