_ .On Decembersl3,'1995, the NRC published a proposed rule for comment in the i

, FEDERAL REGISTER concerning " Constraint Level,for Air Emissions of  :

iRadionuclides." The purpose of the proposed rule is to establish a constraint l

of 10 mrem /yr TEDE for dose to members of the public form air emissions of  ;

' radionuclides from NRC licensed-facilities other than power reactors. i It appears'that the combination of the proposed rule' and existing rules would create a situation where test reactors do'not fall under any constraint;1.evel

. Lwould not apply to power reactors and' test reactors (also called testing facilities in s'ome regulations) because-the section refers toelicensees other ,
