SUBJECT: NRC INSPECTION REPORT NO. 50-302/97-03

NOTICE OF VIOLATION

Dear Mr. Anderson:

This refers to the inspection conducted on March 17-21,1997, at the Crystal River Nuclear

Plant Unit 3 facility. The purpose of the inspection was to determine whether activities

authorized by the license were conducted safely and in accordance with NRC requirements.

At the conclusion of the inspection, the findings were discussed with those members of your

staff identified in the enclosed report. The enclosed report presents the results of this

inspection.

The areas examined during this inspection are identified in the report. Within these areas,

the inspection consisted of selective examinations of procedures and representative records,

interviews with personnel, and observations of activities in progress.

Based on the results of this inspection, the NRC has determined that a violation of NRC

requirements occurred. This violation is cited in the enclosed Notice of Violation (Notice) and

the circumstances surrounding it are described in detailin the subject inspection report. This

violation is of particular concem because three security officers, including a supervisor,

deliberately conspired to cover up the loss of a security badge. The NRC' expects

supervisors to set the standards for employee conduct as well as ensure that subordinate

employees comply with Florida Power Corporation and NRC requirements. A copy of the

NRC Office of Investigation Synopsis is provided as Enclosure 3.

You are required to respond to this letter and should follow the instructions specified in the

enclosed Notice when preparing your response. In preparing your response, we request

that you also specifically address the extent of condition of security deficiencies to determine

if previously lost or misplaced badges, or badges taken offsite were properly handled in

accordance with the provisions outlined in your Physical Security Plan and implementing

procedures. The NRC will use your response, in part, to determine whether further

enforcement action is necessary to ensure compliance with regulatory requirements.

Additionally, based on the results of this inspection, one apparent violation was identified and

is being considered for 6scalated enforcement action in accordance with the " General

Statement of Policy and Procedures for NRC Enforcement Actions"(Enforcement Policy),

NUREG-1600. Your continued failure to protect Safeguards Information, which is discussed

in Paragraph S4.3 of this report, is of paiticular concem because the NRC expects licensees

to, provide lasting and effective corrective actions. The circumstances surrounding this

apparent violation, the significance of the issue, and your apparent inadequate corrective j

action were discussed with members of your staff at the inspection exit meeting on March 21,  !

1997. As a result, it may not be necessary to conduct a predecisional enforcement

conference in order to enable the NRC to make an enforcement decision. However, a Notice

of Violation is not presently being issued for these inspection findings. Before the NRC

makes its enforcement decision, we are providing you an opportunity to either (1) respond to

the apparent violation addressed in this inspection report within 30 days of the date of this

letter or (2) requu,i a g edecisional enforcement conference. Please contact Paul

Fredrickson at (404) 331-3596 within seven days of the date of this letter to notify the NRC of

your intended response.

Your response, if you choose to provide one, should be clearly marked as a " Response to An  !

Apparent Violation in Inspecuan Report No. 50-302/97-03" and should include for the

apparent violation: (1) the reason for the apparent violation, or, if contested, the basis for

disputing the apparent violation, (2) the corrective steps that have been taken and the results

achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the

date when full compliance will be achieved. Your response should be submitted under oath

or affirmation and may reference or include previously docketed correspondence, if the

correspondence adequately addresses the required response. If an adequate response is

not received within the time specified or an extension of time has not been requested by the

licensee and granted by the NRC, the NRC will proceed with its enforcement decision or

schedule s predecisional enforcement conference.

In addition, please be advised that the characterization of the apparent violation described in

the enclosed inspection report may change as a result of further NRC review. You will be

advised by separate correspondence of the results of our deliberations on this matter.

The material enclosed herewith contains Safeguards Information as defined in 10 CFR

Part 73.21 and its disclosure to unauthorized individuals is prohibited by Section 147 of the

Atomic Energy Act of 1954, as amended. Therefore, only the letter, Notice of Violation, and

Executive Summary, and Enclosure 3 will be placed in the Public Document Room (PDR).

To the extent possible, your responses should not include any personal privacy, proprietary,

or safeguards information so that they can be placed in the PDR without redaction.
