COMSECY-96-061; RISK-INFORMED, PERFORMANCE-BASED REGULATION (DSI-12)
Section 3.9 of the Phase ll," Stakeholder Interaction Report" discusses the public 5
comments and Commission Preliminary Views on the subject of Risk-informed, Performance-based Regulation. I have reviewed the information provided and have concluded that the Commission's preliminary view should be reflected as its final view.

Continued implementation of Option 1 along with elements of Option 3 will enable the staff to proceed with exploration of risk-informed approaches at a reasonable pace, without placing an undue burden on the staff; nor will the NRC be put into a position of being far ahead of industry.

i i would also recommend that the staff take a closer look at the applicability of its risk-informed, performance-based initiatives (i.e., PRA Implementation Plan) with regard to nuclear materials licensees, to ensure that the needs of those licensees receive adequate consideration.
