SUBJECT COMSECY-96-061, RISK-INFORMED, PERFORMANCE-BASED REGULATION (DSI 12)

Based on the public comments and the stakeholder meetings, I see little, if any, basis to depart from the Commission's preliminary decision on DSI 12 that selected a combination of Option 1 and elements of Option 3 (Continue Current Process and elements of Perform a Comprehensive Assessment of NRC Regulatory Approaches).

The Commission's preliminary decision specifically requested public comment on how NRC should deal with dual regulation when applying a risk-informed, performance-based regulatory philosophy.

To address the issue of dual regulation, commenters

suggestions included applying the concept of risk-informen, performance-based regulation across regulatory boundaries, and seeking a' common risk philosophy among regulating agencies.

I would encourage the staff to consider the merits of these comments to the extent they can be accommodated within existing budgets.
