Subject: NOTICE OF VIOLATION
Inspection Report No. 50-219/85-33
A routine safety inspection of your radiological controls program was
conducted by Ms. M. Miller of this office on October 21-25, 1985. Areas of
the radiological controls and transportation programs examined during this
inspection are described in the NRC Region I Inspection Report which is
enclosed with this letter. Within these areas, the inspection consisted of
selective examinations of procedures and representative records, interviews with
personnel and observations made by the inspector.
During the inspection, we also reviewed the circumstances associated with a
violation of transportation regulations involving a shipment of radioactive
material from your facility to Quadrex Corporation, Oak Ridge, Tennessee, with
a radiation level on the external portion of the exclusive use vehicle slightly
in excess of the regulatory limit. Our findings were discussed by Ms. Miller
with you at the conclusion of the inspection on October 25, 1985.
The violation has been classified at Severity Level IV based on its low safety
significance since the radiation level was only slightly in excess of the limit.
Nonetheless, the violatior, is of concern because at the time the shipment was
dispatched, the radiation level was only slightly below the limit, yet further
decontamination was
et performed or additional shielding provided.
Subsequently,
upon arrival of the shipment in Tennessee, a survey was performed which indicated
that the levels were in excess of the limits. The violation demonstrates the
need for improved control of such shipments in the future. Any similar violations
may result in additional enforcement action.

You are required to respond to this letter, and should follow the instructions
specified in the enclosed Notice when preparing your response.
In your response,
you should document the specific actions taken and planned to prevent recurrence.
After reviewing your response to this Notice, including your proposed corrective
actions, the NRC will determine whether further NRC enforcement action is
necessary to ensure compliance with NRC regulatory requirements.
