APPEAL OF TERMINATION FOR CAUSE

Dear Mr. Cusanovich:

This is to inform you that the subject grant that was terminated pursuant to the clause entitled " Suspension or Termination for Cause" under the "NRC General Provisions for Grants and Cooperative Agreements Awarded to Institutions of Higher Education and other Nonprofit Organizations", has been converted to a " Termination for Convenience."

In accordance with Grant-Provision No. 5. " Dispute Review Procedure," the Director of NRC's Office of Administration, appointed a termination review committee to evaluate your appeal along with all relevant background materials and documents. A synopsis of the committee's findings and conclusions are as follows: . . _ . .

Findinos:

- The University of Arizona failed to comply with the grant requirement of submitting an Interim Report by December 31, 1994.

- Although not specifically required by the grant, the University, in its letter of July ll,1994, submitted a milestone plan that identified 25 separate tasks with start and end dates.

- While the agency's Project Manager for the grant imposed certain requirements and expectations of performance that were not required by the grant, the grantee did submit the required Interim Report that was almost three months late and was technically inadequate. The report was inadequate because it failed to meet the agency's general grant provision requirements for content of technical performance reports.

- The May 23, 1995, termination letter did not mention that the University of Arizona submitted several reports that, when taken together, discussed project objectives, accomplishments, difficulties encountered and planned actions.

- The NRC Project Manager, in a discussion with the Committee, stated that I he considered five of the bi-monthly reports submitted by the University  :

l of Arizona to be satisfactory.  ;

- Although the Project Manager indicated that he needed bi monthly reports -

to provide a basis for voucher approval, the grant was never modified to require the submission of such reports ,

- The May 23, 1996, termination letter uverstated a deficiency in the .  !

University's April 27, 1995 report.  !

Conclusions:

- The University of Arizona submitted the required Interim Report almost  !

three months after the due date. The report was technically inadequate because it failed to meet the agency's general grant provision requirements for content of technical performance reports. l

- The University failed to adequately respond to the NRC Grants Officer's March 8, 1995. letter requesting a written response stating the steps to ,

be taken by the University to improve performance to adequately address  !

the deficiencies cited therein.

- The University submitted Bi monthly Progress Reports that, when ,

taken together, provided a discussion of accomplishments.

  • difficulties encountered and planned action as envisioned in the Grant General provision entitled " Reporting Program Technical -

Performance."

- The University obtained the assistance of another graduate student to replace the missing student assistant.

Based upon the above, the Termination Review Committee agreed that the University of Arizona failed to comply with the grant terms and conditions and supported termination of the grant. However, in the committee's view, mitigating circumstances existed that did not support the termination of the grant for cause. Accordingly, the Termination Review Committee recommended that the termination for cause be changed to a termination for convenience which the Director. Office of Administration approved.
